Tbe ladies wbo were appointed judges of tbe fruit display at tbe Third Dis trict fair in Pendleton last week com plained bitterly tbat tbe exhibitors themselves, especially in apples and pears bad not taken better care in e leotiug tbeii exbitils. Only one per fect apple display was found aaioug all (be individual showings and tbe rest together with all tbe ears were affected with woiuis, scale, or titter rot. Tbe peaches and grapes were generally pretty clean fruit. They recommended tbat no pre milium be given on any ituperfoot fruit next year. Another recommendation will be tbat tbo individual displays entered be placed iu one location in stead of distributed among all tbe booths as tbo custom tbis year. One feature of tbe task tbat showed a negligeuce upon tbe part of tbe ex hibitors was tbe narnfng of many ex biblts. Some fruit exhibited under wrong names would have taken first prizes had they been properly entered but were under the circumstances thrown out. Tbe objections-raised by tbe judges aro bused upon a desire for more judi cious aud earnest work in bringing tbe fruit standards of Umatilla and Alor row counties up to tbe highest rank. Tbe first decisive victory in the flgbt for tbe enforcement of tbe local option law made by District Attorney Phelps was won Wednesday afternoon when after a deliberation of abont one hour tbe jury iu tbe case of tbe State against Ben Morton, brought in a ver diet of guilty aa obarged. Morton was proprietor of tbe old B'ewery saloon i J Pendleton and was oue of tne first against whom indict ments were returned. Eight true bills were returned against him by tbe grand jury and of tbis number seven indict ments are yet to be disposed of. Tbe man was defended by Will M. Peter son and Col. J. H. Raley. while Dis trict Attorney Phelps personally con ducted the prosecution. Tbe fight ot tbe defeuse in tbe ad dress to the jury was made largely upon the faot tbat tbe witnesses against Morton were detectives. It cost Tom Moffat $1000 because be sold six tits worth of liquor in Pendleton contrary to tbe local option law. Moffat aud two bartenders, Van Goodwin and John Doe Wednesday morning appeared before Jndge Bean in tbe circuit court and received sen tence upon six counts to wbicb tbey bad pleaded guilty. Tbe fines, amounting to f 1000 were paid in cash by tbe saloon men. Nd jail sentence was passed upon tbe men. Tbeowuer, Moffat, who runs the old Joe Sullivan plaoe, was fined 1300 foi his first offense, and $400 for the seo ond count. Goodwin and Doe each reoeived a flue of $50 for their first offense aud were assessed $100 for breaking tbe law the second time.
