The candidacy of Gov. Chamberlain on the Cake platform, adds new com plications to the situation. If the three were to race for the June elec tion, It would certainly add material strength to Mr. Fulton, as both Mr. Cake and Mr. Chamberlain are com mitted to Statement No. 1, or the election of seuator by direct vote of the 'people, while Mr. Fulton is on record as opposing it. But at the April primary, either Mr. Fulton or Mr. Cake must step aside. We have studied tbe situation carefully and draw the following conclusions: 1st. Should Mr. Cake receive the Republican nomination, it will place Mr. Chamberlain "between the devil and the deep sea" without platform to stand on, he having voluntarily as sumed a non-partisan, bappy-go-lucky gait,golng tbe whole hog on Statement No. 1 and telling his Democratic brethren be recently loved so well that he has become infatuated "with most of the Roosevelt policies" until after the June election after which time the probationary state will oeaHe and be again permitted to exorcise his oonacieoce by voting for demo cratic measures in the senate, if elected. 3. That as Mr. Cake has firmly stood for, and manfully defended Statement No. 1, for the past two years there would be no just cause for re publications to prefer new convert from the democrat lo ranks on this question to the exclusion of all other queitolns of vital Importance to the state and nation wbioli will come up during the senatorial term. 8d. lhat in the .light of past his tory, with legislative holdups, cor rupt use of money to "Influence" senators and representatives, men seeking eleotlon to the legist nre on senatorial years to see the fun; special train rnnnlng with all other corrupting influences in connection therewith, thus bringing shame aud diigraoe on the fair name of onr state, our people will never again return to the old system of election by the legis lature. 4th. That a very large majority of the newspapers in the state are first, last and all the time in favor of the people electing seuator. 6tb. That nearly every grange lo the state bat declared by resolution they will not support candidate for the legislature who are opposed to eleotlon bytbe people. fith. That it is repnblicsn measure passed by republican legis lature. 7th. Nearly every candidate that has announced for the legislature hai snbicrlbed to Statement No. 1, at leist in modified form, and those who failed had to come back and take their uiedl- clue. 8th. With 80,000 republican ma jority behind Mr. Cake, would it be possible for Mr. Chabtuerlaiu to juino sideways into the United States senate b'y using a little soft soap on weak-kneed republicans We thiuk not. tth - Should Mr. Ful'ou be nomi nated, the conditions would be en tirely reversed, thus placing Fulton on the defensive Instead of Chamberlain, which would at least greatly reduce he Kebuplican uiajoiity. Three were tried and won, but in two of these he had the assist ance of asam iate counsel, while five civil cases are still undisposed of. What chiefly interests the publio at this particular time is Mr. Newbury's experience and qualifications in the practice of criminal law. Daring the Ave years of his practice he has appeared in but 13 criminal matters, six of these be lost, and five of them be has won, and tbe twelfth his client was tent to the asylum. Tbe five cases won were of minor importance as shown by the records. During: all of hit practice, Mr. Newbury hat never prosecuted sin gle criminal case, never drew i ngle indictment and be it absolutely with out experience along the Hue in wbich he seeks to serve the publio. From thlt it would appear that in criminal prosecutions and practice Mr. Newbury's experience it as meagre and limited as that of any at tbe bar in this district Experience and ability constitute tbe issue raised bj Mr. Newbury in bis challenge through tbe press of some days ago. In point of exper ieuce Mr. Newbury can plead but small advantage. In point of general qualifications, natural ability and aptitude for the position to which each aspires, I leave this to the judg ment of the republican voters to de cide. From boyhood I have made thorough study of constitutional law nd the history of jurisprudence. was always trusted by my friends and colleagues In the Oregon senate to uphold principle of law and bave been the people's champion of some good measure there measures that have met realization in enactment into law and subsequent benefit to the state. I deaire to state that it was not my purpose to break into print and I should not nave done so, but for Mr. Mulkey't diplomatic attack and this is my only apology to offfer for this article. Mr. Mulkey alludes to bis service in the Oregon senate and would bave the people believe that this should fit him for district attor ney, but I can point to a dozen men in Jackson and Josephine counties who bave served in the Oregon legislature, no one of whom would presume that this qualified him for district attor ney.
