NEWS MyEagleNews.com Planning underway for areas around fairgrounds By Rudy Diaz Blue Mountain Eagle Plans have been approved to fund a project that will look into the fairgrounds around the John Day Community Garden and the area along the river. Allison Field, the Grant County Eco- nomic Development director, requested $10,500 from Grant County on Sept. 25, which will go into a joint design project between the county and the city of John Day. Econorthwest and Walker Macy will be conducting a two phase project which will focus on the entire fairgrounds, which will also include the properties that surround the community garden and along the river. The first phase will create a business concept and site plan. The second phase will establish a vision for the future of the fairgrounds property and scope of work. This two-phase project will cost $31,000 with $10,500 coming from the county general fund contingency, $15,500 from John Day and $5,000 from economic development. John Day will carry the contract for the design. In other county court news: • Grant County Court approved the renewal of the snow removal contract with Columbia Helicopters. The contract agreed to $76.50 an hour for removing snow on Grant County Road 24 and Baker County Road 520 in the Granite area. • The second Community Develop- ment Block Grant budget revision and contracts for the environmental review and grant administration were approved for the Heart of Grant County’s domes- tic violence shelter. The final cost of the environmental review will be $18,000 instead of $10,000. • The court approved the purchase of a $3,400 Brady BBP37 Label Printer for the road department. This device will aid the efforts to maximize compliance and safety, said road department employee Ryan Palmer. Wednesday, October 2, 2019 A5 Smith faces three felony charges related to attempted rape By Sean Hart Blue Mountain Eagle The Grant County Sheriff’s Office deputy arrested for attempted rape is facing three fel- ony charges. A Sept. 27 grand jury indictment filed in Grant County Circuit Court accuses Tyler A. Smith, 33, of John Day of first-degree attempted rape, a class B felony, and attempted first-de- gree sex abuse and fourth-degree assault, class C felonies — all constituting domestic violence. The indictment accuses Smith of attempting to engage in sexual intercourse with his spouse — who had initiated divorce proceedings against him — on Aug. 31 “by forcible com- pulsion” and while knowing she was pregnant. The indictment also accuses Smith of caus- ing physical injury to his spouse. All three charges involve a “violation of pro- fessional responsibility” for Smith, according to the indictment. The case is being prosecuted by Grant County Special Deputy District Attorney Gretchen M. Ladd Dobler. Smith is also facing four class A misdemeanor charges of second-degree child neglect. According to information filed in Grant County Cir- cuit Court Sept. 10 by Ladd Tyler Smith Dobler, Smith is accused of criminal negligence for leaving two children under the age of 10 unattended at a John Day residence “for such a period of time as was likely to endanger the health or welfare” of the children on Sept. 4 and Sept. 5. Smith is scheduled to appear on all the charges at 1 p.m. Thursday, Oct. 3, in Grant County Circuit Court. Smith was arrested Sept. 9, but he had already been placed on administrative leave for an unrelated issue. Grant County District Attorney Jim Car- penter said in a statement Sept. 12 Smith had been placed on leave “for issues related to the performance of his duties as a sheriff’s deputy.” COPS AND COURTS Arrests and citations in the Blue Mountain Eagle are taken from the logs of law enforce- ment agencies. A John Day Fish and Wildlife trooper went to the location in the Murderer’s Creek unit to examine the carcass. Evidence of the deer being shot with a firearm was found during the examination. No suspect at this time. Sept. 26: A vehicle was stopped in the middle of High- way 26. The driver was talking with a disabled motorist on the side of the road. Another driver rear-ended the stopped vehi- cle, which was sent to an adja- cent ditch, rolling on its top. Both drivers refused transport by ambulance but complained of pain. The stopped driver was issued citations for driving while suspended and illegal stopping/standing. The other driver was issued a citation for following too closely. Sept. 27: Responded to a report of a hay truck that rolled its trailer on Highway 395C. The truck had come around a corner faster than condi- tions allowed and rolled the pup trailer into the southbound lane. The driver and passenger were uninjured. The driver was cited for failure to drive within lane. The trailer was towed from the scene by Frontier Equipment to their yard. Sept. 27: Responded to a report of a crash on High- way 395C near milepost 15. Arrived at the scene and found two motorcycles were follow- ing a pickup pulling a trailer. The pickup and trailer slowed and signaled to turn onto a For- est Service road on the left. The motorcyclists began to pass the pickup thinking the driver was letting them by. The lead motorcyclist realized the pickup was turning and hit the brake. The lead motorcyclist was clipped by the following motorcycle, which caused the lead to go into a ditch. No-one was injured, and both motorcy- cles were driven away from the scene.
