Last Monday morning while patting sheeting on the Messenger barn up Ash land creek near the planing mill, Levi Eagan missed his foothold, caused by a sudden dizziness, and fell from the comb of the barn to the base ment, a distance of twenty-five feet, breaking both bone3 of hie left arm juBt above the wrist and severely bruising him up generally. Medical aid was procured and as soon after as possi ble be was removed to the residence of Mr. Hatch, on Main street, at which place he had been boarding for some time past. Mr. Eagan is an experienced carpenter and a faithful laborer, and his many friends are sorry to hear of his mishap. His right arm is in a badly swollen condition, having been broken sometime since and was not properlv set. It will be sometime before be will be himself again. The Sturgis Mine Bobbed. Jacksonville, Or., July 12.—Yesterday, while the working force at the Sturgis mine was at dinher, the flume was rob bed. The Sturgis residence, where the men board, is about a quarter of a mile from the mine. They had been piping on a very rich piece of ground and the tailings were caught in a wide flume. Thfe coarse gold could be seen in the rif fles, and the riffles had been dug out for some distance. The dry boxes were still wet when the men returned to work, and discovered the robbers. Two men have always watched the mine at night, but there has never been a watch kept dur ing the noon hour. Mr. Sturgis thinks the robber secured several ounces of gold, and he is satisfied that it was someone well acquainted with the mine who com - mitted the robbery. The following is interesting reading to Jackson county people if it could be in troduced here: It has finally dawned upon the judicial mind that a note or promise to pay ob tained under traudnlent pretense, by which means Ezra Durand swindled a number in this county, is in itself worth less and cannot equitably be collected by legal process. Several years ago farm ers of western New York were swindled by dealers in a new kind of oats. Thous ands of dollars were signed away to these unscrupulous men, who at once disposed of the paper to banks and note-shavers under cover of the “innocent purchaser” ruling. W’hen collection was attempted makers of the notes made a fight. Lower courts, banking upon precedent, held that the notes should be paid. In the Court of Appeals, however, equity, rather than precedent, prevailed. Decision was rendered holding that to fraudulent ly procure negotiable paper was only half the crime; that the other necessary thing was to find a purchaser who would buy without making inquiry. To pur chase paper in this manner was held to be a participation in the fraud and all the notes were declared void. There is something promising in these examples of courts breaking away from the pre cedent that a presumably innocent pur chaser of notes or bonds must be held free from liability in case genuine sig— natures of responsible makers are ap- pended to fraudulent papers.
