T his was a case w herein the appellant, as clerk of Spo k ane county, was convicted of em bezzlem ent. Counsel for Downing urged th at the inform ation w as in sufficient to charge an offense, under th e act of 1893. m aking it em bezzle m en t for any county officer to whom a sa lary is paid to fail to pay to the coun ty treasurer all sums th at shall come in to his hands for fees and charges in his office; also th a t the inform ation d id not charge an offense under section 57 of the penal code. The suprem e oonrt held contrary to this contention in the case of the S tate vs. I sen see. the d efau ltin g city treasurer of New W h at com , and concludes upon the au th o rity of th a t case, th a t no error was com m it ted ill the low er court in overruling th e dem urrer in this case.
