He was tried before Judge Givens on Dec. 3, and was acquited by the jury. Nicoli now asks $5000 damages from the warden and $200 attorney fees, which he is alleged to have paid for his defense. His reputa tion among his neighbors of Esta cada be holds, is worth $5000.
