John T. Scopes, high school science
teacher, was indicted by a Rhea coun
ty grand jury here today on a charge
of teaching evolution in a public
school in violation of the Tennessee
law.
The judge set July 1ft at Dayton

SALEM, Ore., May 25. Circuit
Judge L. II. McMahan today issued
an order directing Frank C. I tram
well, state superintendent of banks,
to appear in court Wednesday morn
ing at 10 o'clock and show cause why
he should not be punished for con
tempt nf court. The action came
when Hraniwell failed to obey an or
der from the court Saturday direct
ing him to be in court this morning,
to explain on affidavit of i. judice
which Hrarnwell had filed directed at
Judge McMahan. The action is taken
in the case of George- Putnam of
Salem against Hramwcl!, 1n which the
harge, as the result of a fiat fight
to a fitiith in the desolate Devil's Gar
den country in southern Klamath
county, accord ng to reports received
by county officers.
The account of the affair said the
two men came to blows over a black
sheep. Only an occasional stray lizard
or sleepy rattlesnake witnessed the
bloody battle, as the two men fought
and tumbled about among the dusty
sagebrush clumps and slute-like lava
rock.
The argument started over the dl
vision of 1040 sheep which bad been
owned jointly. All their differences
had been settled until they earns, to
the last of i lie flock a frisky little
