lapsed on her return from the walk.

court thin morning by F. II. C'hapin,
well-known chimney sweep of Eu
gene, whose tall black hat hns been a
upectacle on the streets of the city
for the lnnl two or three yeara.
Tho judge had fined Chapin and
four of his companions $-.1 each be
cnuse of a "wild party" they had
singed laHt night, and for which they
were lodged In the city Jail by night
patrolmen. Finding the prisoners
were without, money, the judge of
fered to release, thein upon their
promise, to leave- town within an
hour.
'Hulling Hums, who interfered with
patrolmen last night when they were
sending hoboes out of town, was
ill no given lodging In the city jail
lnnt night, and pleaded guilty to tho
charge in city court this morning.

PORTLAND, May 1.1. Details of
a running night battle of guns and
blows on the lower Clacks inns river,
in which wardens nnd alleged fish
pirates suffered slight injuries, were
related yesterday when tho men un
dor arrest entered a plea of not guilty
before Judge Jrfwis at Oak (J rove.
The boats drifted nlmost a mile
down the river during tho fight, which
lasted about half an hour, and which
ended when tho wardens, with their
boat damaged by a pike pole and leak
ing, managed to make fast to that of
the fishermen and to clamhor aboard
nnd moke the arrests. Shots were
freely exchanged, although the offi
cers were under orders to shoot to
cripple the boat rather than to hit
the occupants.
Arrest was the result of the open
declaration of F. M. Brown, chief dep
uty game warden of the state, that
salmon "bootlegging" was a common
practice and that pirates were in
vidiag forbidden territory with nets
an 4 selling the fish to Portland deal

SALEM, Ore., May 1.1. The state
banking board today unanimously up
held Frank C. Drain well, state sup
erintendent of baukti in liis denial of
a petition of it. (biddings to estab
lish a bank on Sandy Boulevard, in
the Hone City park district of Port
land. Giddings had appealed to the
board from Bramwell's denial.
Brain well told the board that to
operate successfully it would be
necessary for a new bank to accumu
late in a short time deposits in excess
of $500,000 and he doubted U 'his
could bt done. He said two other
applications for banks in that district
bad previously been turned down, lie
expressed the opinion that Oregon is
over-banked now.
Mr. Uidditigs said be bad the sig
natures of about 1,000 business men
and other citizens of the community
on his petition who were not satisfied
with their prenent banking - connec
tions because of the long distance of
the banks from their district, lie
said his propused bank would hare a
capitalization of $riO,(HJO and surplus
of 10,000, but that be personalty
could not subscirbe to a great amount
of the stock.
