The state board of forestry consists of the governor, the acting head of (he forest school of Oregon Agricultural college and five electors of the state of Oregon, to be ap pointed by the governor from . and upon the authoritative recommenda tion of the Oregon Plate grange, the Oregon forest fire association, the West Coast Lumberman's association, the United Btates forest service and the Oregon wool growers' association, each to select and name one of such members. The board therefore cou sin tv of seven members, five of wbom are appointed by five different private organizations, Power Too Great. "Assessing property 'for the pur pose of taxation is ono of the mont important functions of government. It is intolerable that such powerB sjiould he exercised by a board the majority of the member'! of which ere appoint ed neither by the electorate nor by any governmental agency whatever, but vulely by private organizations standing in no responsible relation to the state, and controlled, it may be, by persons who are not even citizens of the Btate. The appointment of the, member of the state board of forestry1 in this fashion Is repugnant to the whole spirit of representative gov ernment. Its constitutionality should be tested at an early date by the su preme court. This bill is built up around this state board of forestry, vesting in the bonrd greater power thnn should be exercised by any com mission so constituted. "Another object of the bill seems to bo to permit owners of land to en tor into contracts with the state ex tending over a period of GO years. "Tho payment of one-half of hio taxes baaed on the assessment by tho board of forestry would be deferred (o the end of the term. Lmring the term no other taxes than the property tax so provided may be assessed on any aiich lends or any timber thereon or ou uny profits thereon or upon the business represented by tbeir har vesting. This last provision may u designed to prevent tbel imposition of any severance tax upon the removal of timber from such lands or any tax upon the income derived from tho business of marketing such timber. "Under the present form of our constitutional legislation respecting the power of taxation (article IX, section 1), whereby assessment and taxation are required to be 'uniform' but are not required to the 'equal' there ia eminent judicial authority for the view that the legislature may authorize such a contract between tiie atate and a land owner, and that once auch a contract ia made, it ia binding upon the atate. It may well be be lieved that once thia bill becomes a law all owners of lands within its pur vey will hasten to contract with the state in accordance with its provis ions. If such a contract be binding upon the state, and there ia in mv judgment grave reason to apprehend v-Ri ii would De, tbe atate would be bound to the owners of these lunds for two generations not to change iu any respect whatever its policy of taxation adopted in this bill. Appropriations Cancelled. Governor I'lerce vetoed appropria tions bills totaling 504,7(10. Yester day be completed the work by lopping off $140,683 before the time expired for filing bills and vetoes. Among measures falling under his ax waa aenate bill 207 which, appro priated (2000 annually to assist in experlmentsl snd demonstration work within counties east of the Csscades and for crop rotation experimental work within Umatilla county.
