B. 405, which was passed by the sen ate yostprday and then recalled for amendment, again passed today. It was amended to reduce the size of crabs from seven to Bix and alf inches. The house this morning concurred in the amendments made by the sen ate in the special tax on cigarettes, cigars and tobacco. The amendment eleminated icgars and chewing tobac ca from the tax. The deniocrnts, in a minority, bu? in sufficient strength to break a quorum, fled yesterday in un attempt to b.oc action on the (jerrymander bill and today 1H were reported to be within the .hospitable borders of Ohio, from which state extradition is probable. Two of the minority senators w?ie unable to leave Indiana because of illness. Return Discussed. Republican senators met its usual -it 10 a. in. today, but devoted their dis cussion to means which might be em ployed to "return the fugitives. OP) Having enacted rev enue measures calculated to produce enough money in the next biennmm without increasing the levy on prop erty for stnte purposes the legis lature was to adjourn today. Passage by the Bcnate late yester day of a bill to tax cigarettes, smok ing tobacco, snuff, cigarette papers and tubes, another bill imposing a gross earnings tax on utilities and a mensure requiring payment into the general fund of 10 ppr cent of the earnings of self supporting state com missioners, ended a fight in which Governor Walter M. Pierce bad stood out for this legislation, as opposed to an increase in the levy of proper ty. Cigars and chewing tobacco were exempted from the new tax by an amendment adopted before the cigar ette tax bill passed. While tbe tobacco tax bill was up for final passnge Senator Itoy W. Hitner of Pendleton, predicted that tlie governor would become the tar get for n recall election within six months, because of the revenue pro gram he forced the legislature to ac cept. Senator Milton R. Klepper of Port land declared that referendum would he invoked against the tobacco tax. He said the referendum machinery is al ready "being oiled up." Senator Jay 1 1.
