UP) rossibilit.es of the commercial fish commission bill be ing defeated on the floor of the sen ate without the exercise of the veto was seen this forenoon when it was learned that the criginal group of 13 senators opposed to the measure had been augmented to 14, and that an other senator was wavering on the uuostion. Whether the bill is defeated out right on the floor of the senato there appears to be nt least 14 solid votes to sustain the veto of the governor and 11 votes are sufficient. . - House Vote Heavy . Should the measure puss the senate the plan is for the house immediate ly to proceed to consideration of thc bill and present indications are that there will be sufficient voles in that body to enact it and also to pass it over the executive's veto. Upon it being-vetoed, jt would be tk-t back to the senate from which it originated ami upon the veto being sustained in that body it would be scut to thc legislative cemetery. ' The bill was introduced by Senator Ititner and transfers control of the fish commission from thc governor to the state board of control. It will come up under a special order of bus iness this afternoon at -:I!0 o'clock. Kirkwood Bill Up Representative Kirkwood's bill transferring the control over the game commiss'.i.n from governor to the board of control is also pending in the senate, it having passed the house with enough votes to carry it over the governor's veto. The group of Kl in the senate is expected to sustain the r rnor's veto f this bill thould it pass the senate. It is scheduled to follow the f.sh commission bill. Sivipworth. Thc judge in over ruling the demurrer filed by District Attorney John S. Medley in the diso brought by J. II. Hawley and C. W. Roy el o!so holds that the levy of one mill for the purpose of n timber cruise is n.lo void. Judge C. 1. Rnrnard of the county court stated today that the excess over the six per cent limit will be approximately $10,000 and that this will prnhiibly be cut from the road and bridge item in the county budget. Although the county has to February 17 to take further legal action In the tax case present indications are that the levy will be trimmed to meet the derision as issued today. Judge Rarnard in his opinion con cerning the cut in the budget etates that this will mean that no appropria tion for tJie Eugene-Florence road work will be available this year. Toe court set ?.'t0,000 for this but cut $10,000 and now with another similar cut there will be only $10,000 remain ing, not enough to enter in co-operative work with the state on the high way. The decision fif Judge Skipworth will alio mean that there will .rob ably be no timber cruie in Lane this year. White House Withholds Comment!
