Secretary of State Olcott will have 10 dayB in which to file his anBwer to the In junction suit brought against him to prevent his placing the university referendum on the ballots lor the next general election. After the state's answer the university will havo until the second Monday In October In which to reply but It is thought the university attorneys, W. T. Sinter. -M. E. Pogue and W. M. Kaiser, will file their reply sooner. Judge Galloway will be here be fore the state fair opens and as soon as he arrives It Is thought the attor neys for the university will ask that the case be set down for early hear ing. The state also will want to ex pedite matters, according to Assis tant Attorney General Van Winkle. The hearing will be before Judge Galloway. . Klther side will have the right to appeal the case to the supreme court and unless an unusually conclusive fight Is put up by one side and a "fall down" registered by the other the case will go to the supreme court. As neither of these things are expected to occur but rathor a close fight -is expected, It is antici pated that the case will be passed upon by the Btipreme court. The case could hang fire In the courts over 12 months and yet be decided In time to place the referendum on the ballot but Assistant Attorney General Van Winkle thinks the case will bo finally decided before Janu ary 1, the date on which the money appropriated for the university be comes available under the bills. Secrotary Olcott Is placed ill a pe culiar position by the filing of the suit, which Is directed at him. By virtue of his office of secretary of state he is also a member of the board of regents of the university. At a recent meeting of the board he suggested that the members of that board start a subscription to assist in paying the nttornoys' fees for the fight against the referendum, and he Is an avowed supporter of the university. At the same time he Is made tho sole defendant In the two suits which havo been filed here. Among the al legations is one that Olcott, as sec retary, did not examine the names to dutormine whether they were fraud v.ent. "Such an allegation Is somewhat misleading," he said today. "I con sidered that I merely acted In a min isterial capnclty, nnd that it was not my duty to determine whether Buch names were forged. In fact, it 1b a manifest absurdity for anyone to be lieve that I could or should do so, when It Is remembered that for many weoks at a time several detectives and handwriting experts were busy exMilnlng the petitions to 6cur eviStnce. "Perhaps such an allegation It an essential part of the complaint, but It places me in a bad light, as though to a certain extent I were trying to abet the referendum, when, as a mat ter of fact, my poBltlcO, as set out by the law, is merely to take huob petitions and file them. HAS FIFTY STUDENTS With nearly 60 students register ed for the freshman class, me new Reed college wll begin its career un der very auspicious circumstances. It Is true that the new buildings will not bo ready by the opening day, September 18, but temporory quar ters have been secured at Eleventh and Jefferson streets, which will bo occupied until the buildings are in readiness. Of the 4 6 students that have qualified for the opening class, 18 are from the Washington High school, 8 are from the Lincoln High school, and 7 are from the Portland academy. Journal. S. .Myers at 15 cents. The contract was made March 24, Eleven similar contracts filed during tho present year are on file in tho recorder's otil'ce, the price ranging from 11 to 15 cents, with the mu- Jorlty at the latter figure. There are other contracts for 1911 crops made in pre- vIoub years, and the con- tracts include the big Witch Hazel and Sinclair yards. Still there are many growers not tied up and they will reap a liurvcat from the high prl- ces. As usuali reports of the condition of the yards vary, but taken as a whole, it is probably an average year. CITY VIEW HOUSE DESTROYED BY FIRE Was Not Vet Finished Origin of Fire Is Mystery. and Fire destroyed a new story and a fcalf fiV-e-Toom bungalow in City view Park in the southwestern part of the city Saturday night. The fire started from unknown cause about 9:30 and was too far out to be reached by the city department. The building was new, finished about a moth ago, although the owners A. N. Trawlck and J. W. Coleman, had arranged to have some more painting and papering done and had a lot of paint there for use. The building had not as yet been accu pled, and no fire had even been us ed in It, and no one had been on the premises for several days to . the knowledge of the owners. The cost of tho house was between $900 and $1,000. Insurance tor $500 had been placed with the Farmors' Mu tual Fire Relief association and a vacancy permit applied for, though not yet received at the time of the fire.
