They were closely cross-examined but ad hered to their stories, even to the part concerning Mrs. Hayball's going to the door of the room after Mrs. Hay bull bad stated on the stand that she knew nothing of the murder until morning when Timmons, blood-stained, came to the door of the living room. A dramatic Incident arrived when Timmons was confronted with the axe which was found under his mat tress. The deputy district attorney held up the weapon, which had a blood-stained handle, and It was then Timmons nearly broke down and ad mitted that he may have struck his wife with the heavy Instrument. . For tbe defense Timmons himself I was practically the only witness. He said that he (TimmonB) was lying in bed next to the wall and that he and his wife had been drinking during the evening. He said that he was awak ened about 12:30 o'clock and found that his throat bad been cut. He stated that his wife was In bed on her knees, and that as there was a lamp burning in tbe room he saw her holding a razor in her right band. He then said he got upon his knees in bed and took hold of her right wrist i with his left hand and they commenc ed to scuffle. With his right hand, he states, he finally wrenched the razor away from her.
