Mains, Jr., in the killing of William E. Annis was adjourned to night until Monday, after a day in which the state developed the strong est testimony so far adduced. Two witnesses, Herbert L. Funke and Ar thur Andrews, eye-witnesses to the shooting, swore that there was an In terval between the first shot fired by Captain Hains nt Annis, and the oth ers came in fairly rapid succession. Boih of these club members declar ed positively that Thornton llulns aimed his revolver at those on the float after the first shot, and before the succeeding shots were fired. An exhaustive cross-examination on the tmrt of the prosecution fulled to shake their testimony. Mr. Andrews stated that after the first shot he saw the defendant aim his revolver at witness' father. "There was a shot, then an Inter val, when there were some more shots in quick succession, then a pause and a last shot, which went through the sail. 1 ran when I saw Thornton point bis revolver at my father, and stood under the dock." said Mr. An drews. Graphic Story of Shooting. Mr. Kunke gave a graphic descrip tion of the shooting of Annis. The captain was standing by with his arms folded, and waited unttl Annis boat swept up beside the float, and then, lifting the obscuring sail, Hains fired several shots at the publisher. Mr. Kunke said he saw Captain Mains on the float as the Annis' boat rime In. Thornton Hains was standing about a yard from the cap tain, who seized the boom of the boat with his left hand and with his right drew his revolver. Crying "Annis" Die captain fired, and almost Imme diately Thornton Hains aimed a re volver at the witness, who was about seven feet away. The witness said that Captain Hains then fired about four more shots at Annis, then paused and fired again. Mr. Funke said that he could not be certain but thought Cap tain Mains fired six times. Thorn ton Mains did not address hfm while aiming the pistol at him.
