Roy Lamphere Gets Hard Deal

La Porte, Ind., Nov. 25. The
state scored a big victory in the Lam
phere trial when Judge Richter, after
exhaustive arguments on both sides,
announced that he would instruct me
Jury that if the evidence shows that
Lamphere set fire to tne uunness
house, even if the fire did not cause
the death of any persons therein, the
Jury must find him guilty of arson.
The Instructions will also contain a
paragraph that If the Jury finds that
any one of the four persons in the
house lost his or her life as a result
of the fire, and that Lamphere set
that fire, then it must find Lam
phere guilty of murder of manslaugh
ter. -

The first national bank today re
ceived a few samples of the new to
and $2.50 gold pieces. They are
strikingly different from the old
coins and are quite pretty. On one
side is an Indian head with the word
"Liberty" at the top and the date of
coinage, 1908, at the bottom. On the
reverse side is an eagle. At the top
are-the words "United States of
America," and at the bottom "2 1-2
dollars," or "6 dollars.". On either
side of the eagle are these inscrip
tions, "In God we Trust," and "E
Plurlbus Unum." Those who want
the coins as souvenirs can procure
them at the bank at their face value.

160 feet, was passed.

LAW IS VALID
Salem, Or., No. 24. In affirm
ing the decree of Judge C. U. Gan
tenbeln, of the Circuit Court for
Multnomah County, in the case of
Sylvester Farrell vs. the Port of
Portland, the Supreme Court this
morning validated the adoption of
the amendment to the act creating
the port, authorizing the Issuance of
$500,000 bonds for the purpose of
establishing and maintaining an ef
ficient towage and pilotage service
between Portland and the sea. The
opinion Is written by Chief Justice
Bean.
This action was brought to enjoin
the Board of Commissioners from
carrying Into effect the provision of
the amendment, which was proposed
by the Initiative and adopted by the
voters on the ground that such law Is
void. In passing upon the salient
features of the case the court held
that the Port of Portland Is a muni
cipal coroporation organized in pur
suance of an act of the Legislature
of 1901,-but that it Is neither a city
or a town in the strict, technical
sense. '

Trenton, Nov. 25. Governor Fort
has been requested by Prosecutor
Bernadine of Middlesex county to
send troops to Perth Amboy to quell
the riot there. The governor refused
and said the request must come from
the sheriff, but notified Colonel Du
gan to hold the Trenton battalion In
readiness.

were driven from their homes today

stroyed throe four-story buildings on

sioned a loss of $75,000.
