saleswoman and asked to be shown
a certain kind of a dress. The Kales-
woman compiled with the request
and the prospective purchaser was
quickly satisfied. Khe ordered the
dress done up In a parcel, and as the
saleswoman did so, asked that ft be
harKcd to her husband, Harry Red
ding, steward at the I'ortland Hotel.
This the saleswoman could not do,
and referred tho youiiK womun to
Mrs. M. K. Ilccker, the proprietress.
Tho young woman walked back to
Mrs. Decker s desk and repeated the
request. Mrs. llecker demurred, de
claring; that she would call the hotel
by phone and ascertain the reliabil
ity of the proposed creditor. The
youiiK woman protested and refused
to consent to such action. She in
sisted that she lie allowed to take the
dress with her and the bill be sent to
her husband. Mrs. Becker refused,
but meanwhile the saleswoman had
placed the parcel ciintuliilng the dress
near the young woman.

The defendant. In her own behalf.
I swore that .s.ie was In hugene at me

several days belore. .She went into
detail as t i h.-r movements during
the time preceding and following the
theft. Her statements were corrobo
rated by all the witnesses for the de
fense. In her behalf her mother and a
number of friends from Kugene were
present as witnesses. Among them
were Mrs. Mary E. Honig, mother of
the defendant; Mrs. (Jeorge McMann,
Mrs. Julia Caylor, -Miss Krankle Cay
lor and Mrs. Claude Gaby.
A young saleswoman at Meier &
Franks testified positively that the
defendant was not the woman who
came to the department store and
asked that a dress be charged to
Harry Iteddlug, her husband. She
described In detail the other woman,
who had represented herself to be the
wife of the hotel steward, but was
positive that the defendant was not
tint woman.
In rendering his decision Judge
Van Zante not only found the defend
ant! not guilty, and dismissed the
case, but look occasion to declare
