Vctertlny Afternoon. United States Judge Wolverton vesterdav denied the motion of the defense "for an Instructed verdict of acquittal in the James Henry Booth bribery trial. The motion was pro posed 'immediately after the govern ment rested its case and alleged that the prosecution hud not presented sutricient evidence to justify or sus tain a verdict. After the jury had withdrawn, the application for a non suit was argued at considerable length by Judge Becker and United States Attorney McCourt, for the Gov ernment, and Judge Webster and Mr. Malarky for the defense. Following Judge Wolverton's rul ing denying the motion, court ad journed at 4:30 o'clock until this morning. Defense to Submit Case. At a late hour last night it was de cided by counsel for the defense that they will submit their case at the op ening of court this morning.
