Whltson, the commercial truveler who forged several checks and passed them upon the Hotel Smeede und the Chambers Hardware Company here several months ago, and who has been In the county jail here for the past two or three months, having been arrested at Wal la Walla shortly after the commission of the crime, was discharged .from custody by Judge Harris, of the cir cuit court, this morning upon motion of the district uttorney. The rea son for this action Is that the prose cution deemed that the ends of jus tice had been served already in that Whltson hud made good the amount obtained by his forgeries, hud paid the costs, amounting to over Slue and has spent a good length of time In jail. Henry Jones Freed The grand Jury In the ease of the State vs. Henry Jones, accused of con tributing to the delinquency of a mi nor girl, this forenoon reported not a true bill and he was discharged. Jacobs and Hop Indicted. The two secret Indictments return ed by the grand jury yesterday after noon were for Jos. Jacobs and his son Anthony, the charge against them being selling liquor. The case of W. G. Allen vs. the Webor-Bussell Canning Company, to recover money, went to the jury at 3 o clock this afternoon. The next case to be taken up was that of C. P. Houston vs. Fred risk to recover property. Hon here, came up from Portland last night on business. Miss Mabel Martin arrived here today from Everett, Wash., to visit at the home of her grandparents, Mr. and Mrs. W. W. Haines. Mrs. C. P. Tilton, of Ashland, after a short visit In Eugene, left on the noon train today for Albany, where she will visit a few days. Ralph C. Oglesby left today for h'o home In Wheeler county, after hav ing been In Eugene a few days prov ing up on his timber claim. Dow Huff, a brakeman on the West Side branch of the S. P. Co., is visiting his mother and brothers and sister In Eugene a fe wdays. A. C. Bassett, of Menlo Park. Cal., arrived In Eugene this morning and left during the forenoon for Deer horn, where ho will enjoy an outing. Geo. H, Kelly and A. S. Dixon. of the Booth-Kelly Lumber Company, went to Saginaw this afternoon to look after the company's affairs there. Horace McClure, formerly of Eu gene, passed through here Monday evening for his home at Seattle, after having been on a trip through the East and South. The wife did the cooking, took care of the homo and the children, while the husband worked In the pottery. Edmond Spier was not a very good workman. He was rather Inclined to study processes for saving labor or of producing new and useful articles. His wife, who was a practical wo man, bad to bear ber share of ber bus- band's handicap. She often argued with him as to the futility of dreaming nbout new processes none of which be bad the ability to Invent and being thus drawn from bard work which might advance bis wages and render the family more comfortable. But It Is impossible to change people's dis positions, and Molly Spier, at last gave up trying to change that of her husband. Meanwhile there was no addition to the comforts of the home. The larder was no better. the furniture was get ting more shabby, and the children were ragged. What with the cooking, the housework nnd the patching of clothes Molly , Spier was having a hard time of It. But with nil her prac ticability ber amiable disposition could no more be changed than could, her husband's proclivity to dream. But one day Edmond came borne train the factory with a burning fever onilm, and It was evident that be was In for a protracted illness. There were no unions in those days to take care of a man when be was ill, and the Spier family suffered great ly. Molly Spier got odd jobs to do, which helped to keep them from starv ing. Edmond applied to his employer for help. The pottery owner wns( a cold, calculating business man and re plied that if he began to pay wages to one of his men while ill be would end in having to pay all under similar cir cumstances. This killed all hope of ob taining anything from that direction. One day Molly spent what money she had on hnnd for some fresh pork. Having liotnhi more of it than she could use In a short time because it was cheap, sue determined to cure a part of it rutting some salt In a com mon cooking vessel such ns was used in those days, an unglazcd porous af fair, she filled It with water and set It on the stove to heat. Then she went out to attend to another matter. Edmond, who was now convalescent, was In the only other room lu the cabin spending his time, ns usual, day dreaming. He began by inventing in Imagination a vessel hard glazed like glass, a substance that no water could penetrate nnd neither heat nor cold crack. Having Invented this Imaginary vessel, he proceeded to sell his Inven tion for a fabulous sum, build a house, dress his wife lu silks and satins and the children In equally line apparel. He heard something sizzling in the kitchen, nnd it occurred to him that he should go In there and see what was wrong and correct It. But nt that mo ment he was figuring up bis fortune, and the matter passed out of his mind. lie was still drenmlug when be beard Molly go Into the kitchen and utter an exclamation of Impatience. Then she came .Into where Edmond wns lying, holding nn empty saucepan, nnd for once since bis IHiiasb lost her equn nlmlty. "All the salt I bad Is gone," she Bald. "I put It on a hot fire with water, which boiled over. Besides, just look at the saucepan. There's something on the outside thnt won't be rubbed off. Tho pan is spoiled for looks if not for use. I do think you might hnve gone Into the kitchen and prevented tho damage." Edmond took the saucepan in his hand and examined it. Where the salt and water had boiled over the vessel was glazed. He scratched It with his nail without effect. He took out his pockotknlfe nnd tried to scrape It off, nil to no purpose. "Molly," he said, "you've made lis rich." Yarnell re cently bougnt the lot on which the building will stand from Professor F. S. Dunn, immeaiately adjoining the latter's residence. Mr. Yarnell will build the house and he will call It Edna Hnll, as a memo rial to his daughter, Miss Edna Yarnell, who- wa3 drowned in the millrace whllecanoclng on April 1st of this year. The building will be three stories high, with a full basement, and will be in the style of an English country home. It will have a spacious porch in front and on the first floor will be located a living room, a reception hall, a music room, a dining room and a study room. On the second floor there will be six bedrooms with two closets each and the same' num ber on the third floor. The contract for the erection of the building was let this afternoon to C. J. Buley.
