Sam Smith was arralngned In the circuit court before Judge W. L. Bradshaw at 2 o'clock this after- noon on four Indictments filed by District Attorney Frank Menefee. He is accused of burning a sheep herder's house at the shearing plant of ex-Congressman J. N. Williamson, of exposing poison for the purpose of killing Williamson's sheep and with cutting wire fences on the property of Charles AUschul, leased by the former congressman. On request of his counsel,. Smith was given until tomorrow to enter a plea, and It Is probable that the first trial on one of the arson charges will npt begin until Wednesday. The defendant Is at liberty on $5000 bond. The trial or Smith will undoubted ly be one of the greatest legal bat tles ever witnessed in this part of the state In the prosecution the District Attorney will be assisted by his deputy, W. A. Bell, and H. S. Wilson, of The Dalles, who assisted In the defense of Williamson during the land fraud trial. Smith will be defended by J. R. Wyatt and J. K. Weatherford, of Albany, and George W. Barnes, of Prlnevllle. Practically the entire population of Prlnevllle Is arrayed on one or the other side, and no topic is be ing discussed. Both Smith and Wil liamson have many powerful and loyal friends and the defendants In their struggle for vindication will have the advantage of everything that money can procure. Up to the beginning of this con troversy, Smith, who is a cattle man, and Williamson, who is a sheepman, have been warm friends. In fact, Smith was Indicted by Francis J. Heney on the charge of attempting to Influence witnesses In the con gressman's behalf. This charge has been held over him for a long time. It Is generally maintained that this affair has little to do with the war between cattle and sheepmen which for a quarter century has blackened the history of Crook county. In vestigation, however, shows that It Is a logical outgrowth of the condi tions which have prevailed, for so long. The basic theory of the pros-j edition is that Smith committed thei crime charged because Williamson 1 refused to buy his hay or the right to graze his sheep on his stubble dur ing the winter. Larkln Elliott, a sheepherder formerly In Smith's em ploy, who was jointly Indicted with him on the various charges, 1b said to have made a full confession of the crime alleged. While this is com mon street talk, the authorities are extremely reticent and will make no admissions other than that El liott will be a witness for the prose cution. Anticipating such a devel opment, the attorneys for defense will have many witnesses present to attack Elliott's reputation for ve racity. The main line of defense will be that Smith is the victim of a far reaching conspiracy arising out of political enmities, in substantia tion of this allegation they point to the fact that Smith was arrested and held in jail for a week, although his friends could have given bonds for $ 100,000 If necessary, and was denied ball until an order could be procured from Judge Bradshaw, then at Baker City. His son, Stanley Smith, aged 14 years, it is said, was qlen haM a n.lonnap nn fk miRiemea- nor charge for a week, and cut off from all communications wun rela tives and friends, it is said, how ever, that although sweated dally by officials, that the lad revealed nothing which would assist in the prosecution. Everything In Prlnevllle is quiet, and the majority of the citizens say It will remain so during the trial. There are many to doubt this, how ever. Sheriff Frank Elklns is be ing praised by jnany as the Moses to lead Crook county out of the wil derness of lawlessness. Smith sym pathizers, on the other hand, de nounce him as a tool of the William son faction.
