A bit suit has been begun In the Benton county circuit court. It la fur the recovery of $5,000 and the plalntiH is Mrs Maud Geary. The defendant ia the Provident raving Life Aaaurance rioolety, of New York . The latter is a life Insurance concern In which the late Captain Woodbridge Geary's life was insured for $5,000. The occasion for the suit ia the point blank refusal of the Insurance people to pay the pohoy. The premiums were all kept paid up, and proper proof of death waa furnished, but In apite of it all, the company persists lu withholding from the bereaved widow that for whlob the premiums were patiently aud promptly paid. It Is hoped that the courts of juxtlce may, In this iDstance, be lu fact what they are In name. The papers were filed several days ago, and the case should be tried at the November term. The plaintiff recites that plalntifl and Woodbridge Geary were, married In Texaa, August 5,1888; that January 8, 181)6 Captain Geary took with the defendant Insur ance company a policy of $5,000 on bis life, tho amount to be paid within 60 days after proof of his death; that July 4, 1808, tbe Insurance policy was de stroyed by fire that burned the family residence In Cnrvallis, Oregon; that Woodbridge Geary was killed In tbe Philippines, October 11, 1890; that proof of death waa Immediately fur uiahed to and aocepted by tbe Insur ance company; that payment of tbe ainouul, of the policy waa and still is refuaed. The point on which the company withholds payment Is tbe following olause In the printed policy to which Captain Geary subscribed at tbe time of making the application: "That I will not peraoaally engage In military or naval servloe in time of war without Aral obtaining In eaub unci every case the written consent of the society." But Mrs Geary alleges that tbe company waived this condition In tbe policy and re leaaed Woodbridge Geary from per formance thereof in this: that at the time of taking out the policy tbe agent of the company was informed that the a pplleant was engaged In active ser vice in the U H army and that written permlaalon was at that time given him at all times to engage in warfare; and that said permit was destroyed by Ore. A good market could be bad here for the Oregon apples If they could be sold for $2 gold per box.
