aud commenced work In November,
earning $.1724 during the year. But
alow progress waa made, owing to tho
great depth of water, due to recent
scouring, which rendered operatlona
dlfllcult. Considerable dlfllculty Is
anticipated In extending the jetty, aa
It Is expected the current will continue
to scour at the bottom aa fast aa the
jetty is extended. At present Wi-foot
piles are required. When the work lias
been completed the channel ia ex
pected to take a more southerly course
than at present. The depth of the
channel now varies from 8 to 24 feet
across the bar at high tide, the
average depth being 17 feet. A vacant
tract embraolng alx acrea of publlo
landa near the mouth of the river has
been temporarily withdrawn from
sale, aa it oontaina atone suitable for
Jetty woik, which la to be used in the
Improvement. The government also
anticipated purchasing the Point
Terrace quarry near by. The balance
on hand will permit the building of
the Jetty for 200 feet, but further appro
priation will be necessary to extend
the Jolty the additional 600 feet desired
Four thousand, three hundred and
eleven dollars la now on hand.

alio found that he was in quick sand.
By herculean woik he recovered the
wheel. The wild wa.es continued
daahiug over him. Finally be placed
the bicycle In an upright position aud
rested upon it. After a time he Ih gan
to make a little headway toward the
shore, but ouly by inches. When in
a few feet of the bank he sank in about
three feet of the treaclit rous t-aud
again, but he had tufllcieutstreiigth to
reach a limb oi an old drift sticking
up. By renting mi his wheel tie wrote
a few words lo his wife raying his
body would be found ill the bed of the
stream. After this he gave out c in
pluiely and thought he was lost.
He reclined over against hla bicycle
and passed into uiicniiciuUsuees.
When he uwoke it was 11 o'clock at
night and lie iiad been washed to the
boat, aud he got out in a hurry. He
thinks the wheel saved his life. He

ease of E L Mlms, convicted for man
slaughter, reluse a new trial, and
tiri'iiis the judgment of the lower
court. Judge Lowell sitting. The
opinion la by Wolverton, J. The
sentence was for five years In the peul
tentlury. He has been in the county
jail here since the trial, which resulted
in his conviction, last fall, In the hope
that a new trial would Le granted by
the supreme court. Being convicted
of manslaughter, although charged
with murder in the first degree in kill
ing J Henry Miller, If a new trial had
been given, be would have been tried
ouly for manslaughter, and could not
aguln been tried for murder.
