Ness, wife of S P. News, of this city, to secure a writ of mandamus in the court of the District of Columbia, to compel Secretary Garfield, of the department of the interior, to allow her to prove up on her timber claim on the Coast Fork of the Willamette river, without personally visiting the land, the court granted the mandam us, overthrowing past precedents. Heretofore a citixen could not prove up on his claim without visit ing it. Thus, if be were sick, no pat ent would be granted him, and the timber people would have to take their patrons to the laud, whether able to go or not. S. 1’. Ness received a telegram to day from his attorney stating that his wife had won, and that the land office had lost. No Indication as to the reasoning of the judge was given.
