June 30, Confessing that the testimony of its star witness against James Henry Booth hud tak en It by surprise, the Government this morning laid the foundation for impeaching Fred* rick A* Kribs, who gave Booth the 8800 check, for which Booth is on trial, charged with ac cepting a bribe, while receiver of the Roseburg Land office. The government uiay not Impeach Kribs. however, but the fact remains tliat the prosecution is far from sgt- isfieq with his sto*-y on the witness stand, as It does not agree with the affidavit he made concerning the transaction to W. J. Burns, January 16, 1905. Neither Is the defense satisfied with the testimony of Kribs, althougb the government's star witness has conflrfried the opening statement of the defense to the Jury that the check was given for an option aud not for information from the land of fice. Kribs' testimony, taken alto gether, is considered conflicting unsatisfactory Yesterday Kribs tually admitted that the check given to Booth as compensation obtaining for Kribs an option on tain timber claims as by the fendant's explanation of the transac tion . On cross-examination, Kribs aduiitted ihai Booth had never In formed him that any of the lands In cluded in the lists Introduced iu t*vl-> d< nee by the Government had been held for cancellation. Kribs flatly contradicted the testi mony of ex-RCglster J. T. Brldges, one of the government's principal witnesses. Bridges testified that 1 early in the yvai 1 1'03, Kribs held a conversation with himself aud Booth iind he made arradgeinents by which the two Land Officials were to be paid 825 for each selection of which Kribs was to lie advised In advance of its final cancellatl n. Kribs, on cross- examination by Mr. Mnlarkey, de clared that he had never had a con versation when Bridges and Booth both wer»* present and that he never offered to pay them 82 5 or any other sum for any Information they might furnish him. The witness did testify that he had complained to Booth about losing several valuable land se lection and was desirous of being kept posted on the subject Kribs said that be told Booth at that time If he would keep hl niposted Kilg*< would "make it all right with him.” LITTLE INTEREST Cooperstown, June 30.
