FOR ASSAULT

Cottage Grove, Sept. 28—Charles C.
Rutan, aged about 35 years,was killed
by the accidental explosion of dyna­
mite in the Bohemia mining district
yesterday afternoon. He was doing
assessment work on George Long's
mine on Elephant mountain and was
kneeling, holding a stick of dynamite
in his left hand, trying to insert a
cap and fuse. The explosion came
suddenly and without warning and
shattered Rotan's left arm and leg
and injured him interually. lb- was
carried to the Mustek mine, where
medical aid was administered, but he
died about two hours afterward. He
retained consciousness up to a short
time Itefore his death.
Several men working with Rutan,
including Wm. Reed, had a narrow
escape, as they were within a few feet
of him, but they were practically un­
injured.
The body was brought to Cottage
Grove on today's train and ship|>ed to
Oakland, Or., for burial, the deceas­
ed's brother in law,J. A. Underwood,
of that place, having arrived here
ast night to attend to the matter.
Rutan was a single man and leaves
a sister, Mrs. Underwood, aud a
mother.

WANTS DIVORCE
Mrs. Florence Edyth Spaulding liar
instituted suit in ‘the circuit court
agiust her husband. Airy L. Spauld­
ing. for a divorce and for the custody
of their minor child, R.-giuald Gard­
ner Spaulding. aged 17 month». They
were married in Michigan March 19.
HMM. Cruel and inhuman treatment
is alleged Spaulding's last known
address waa Appleton, Wisconsin.

Fred P. Gossei, a farmer residing
four miles northwest of t-dmi'.a, lias
begun suit in the circuit court against
George Sweet, Daniel Sweet ami J >-

have been incurred as a result of nn
assault upon the plaint iff by the de­
fendants, the papers iu the ease l»e-
ing tiled by Attorney Lee M. Travis
this afternoon. In his complaint the
plaintiff alleges as follows:
"That on or about the evening and
night of March 8, 1906, iu lame coun­
ty, Oiegon, the said defendants act­
ing together, did break into the resi­
dence of plaintiff, and drag him
ftotn hie couch and drag him out
upon the porch, and did then and
there purposely, maliciously and felo-
niously assauI’ and beat plaintiff
upon and about his head and body
with two laige clubs, breaking his leg
and mashing lhe Ismes of bis leg, and
thereby iullieted great bodily harm
upon the plaintiff.
"That the plaitniff was knocked to
the ground several time», ami ren
dered unconscious; that the plain-
tiff's leg was badly broken and the
bones theriof mashed, hum large
wounds were made upon plaintiff's
body.
"That at the time deferdsnts were
