Monmouth Herald Monmouth, Ore, Oct. 10, 1919 Pace 4 Continued from pare 3 luch improvements, alterations or repairs, and assess upon the lot or part thereof the cost of such im proTements, alterations or repairs, us provided in sections 34, 35 and 36 of this act; provided, that the common council may order all such improvements, alterations or repairs in whole or in part to be paid for out of the general funds of the city; and provided, further, that in all cues for repair of sidewalks, the council may order such repairs to be made within ten days of the ser vice of a copy of said order, certifi ed by the recorder, upon the owner or possessor of the adjacent lot or lots, or in case said parties are not found, then within twelve days from the date of posting said certified copy in a conspicuous place upon said lot or lots, near the repairs ordered; provided, that where the common council shall deem it ex pedient to the interests of the city they may at their discretion re duce the amount of time in which the owners of lots abutting on proposed improvements are allow ed for doing said work but in any case time allowed shall not be less than ten days. . Resolved Further, that this reso lution for proposed charter amend merits submitted to the voters by the council be filed with the record er of the city of Monmouth for sub' mission to the legal voters of said city for their rejection or approva to be voted upon tt a s cial elec tion to be held as herein provided, Resolved Further, that the coun- cil of the city of Monmouth deems it advisable and does hereby and herein call and make necessary pro vision for the holding of a special election which shall be held and is hereby called to be held on the 21st day of October, 1919, between the legal voting hours cn said date at the council chamber in said city, which is hereby designated as the time and polling place for said spe cial election; Resolved Further, that 0. A. Wolverton, D. M. Hampton and G. W. Chesebro are hereby appointed judges for said election and How ard Morlan and Harry Stine are hereby appointed clerks therefor; '. Resolved further, that for the here ioabove proposed charter amend ments the following ballot title be and the same hereby is adopted by the council: CHARTER AMENDMENTS SUB MITTED TO THE VOTERS BY THE COMMON COUNCIL AN ACT To amend Section 33 of an act to incorporate the city of Monmouth approved February 6, 1899, as sub seqently amended by the legal vot- en of said city at elections held (herein on June 5, 1911, November 27, 1913 and April 30, 1917, allow ing the council to reduce the time in which abutting property owners are allowed to do the work but in no case shall same be less than 10 days. 106 Yes. 107 No. . Be it Further Resolved that the recorder be ?nd he is hereby in- structed to publish the hereinabove proposed charter amendment sub mitted to the voters by the council in the manner required by law, that is to say, by the publication of this resolution in full in the Monmouth Herald, a newspaper published in the city of Monmouth and hereby designated by the council, for two consecutive publications thereof within the twenty (2d) days imme diately preceding ami special elec tion at winch said proposed amend ments are to be voted upon. Be it Resolved by the Council of the City of Monmouth, Oregon, that the following rroposed amend' ments to the charter of slid city be and the sime are hereby submitted to the voters thereof for approval or rejection at the special election herein provided fur, to-wit: AN ACT To amen lan act entitlel "An act to incorporate the city of Mon mouth in folk county. Oregon, and to repeal all prior acts or parts of acts to incorporate said city ot Mon mouth, and all amendments there to" approved February 6, 1899, as subseauently amended by a meas? ure submitted to and approved by the voters of said city at an elec tion duly called and held therein on June 5. 1911. and also as subse quently amended by a measure sub mitted to and approved by '.he vot ers thereof at an election duly called and held in said city on No vember 27. 1413. and as further amended by a measure submitted to and approved by the voters of said city at an election duly called and held tnerein on April 30, 1917, and to amend all other amendments amendiii2 said act enacted by the Legislative Assembly or by vote f the people. Be it Enacted by the People of the Cy of Monmouth that an act entitled "An act to incorporate the city of Monmouth in Polk county, Oregon, and to repeal all prior acts or parts of acts to incorporate said city of Monmouth, and all amend ments thereto" approved February 6, 1899, as subsequently amended by a measure submitted to and ap proved by the voters of said city at an election duly called and held on June 5, 1911, and also as subse quently amended by a measure sub mitted to and approved by the vot ers at an election duly called and held in said city on November 27, 1913. and as further amended by a measure submitted to and approved by the voters of said city at an elec tion duly called and held therein on April 30, 1917, and to amend a other amendments amending said act enacted by the Legislative As semblv or by vote of the people be and the same is hereby amended by addine thereto Sections 54 and 55 to read as follows: Section 54. Whenever an as' sessment has been made against property benefitted, for any im provement of any character men tioned in this charter, and the pro ceedings of any portion thereof, whereby such assessment has been made, shall be declared invalid by any court of competent jurisdic tion, becauso of any defect, juris dictional cr otherwise, or of any ir regular'ty or informality, the City of Monmouth may within one year from the date of the entry of such judgment or decree declaring the same invalid or defective, maintain an action in the Circuit court of the state of Oreg.m for Polk county, against the owr.ers of the lots or lot, block or blocks, parcel or par cels of land upon which the costs of such improvement or repair of any street, avenue, lane or alley, sewer or drain, should be imposed under the terms of this act, and recover the proportion of the costs of such construction, improvement or re pair to any street, avenue, alley, sewer or drain, properly chargeable under this act to each of said lots or blocks or parcels of land, includ ing reasonable attorney s lees or maintaining the same. Section 55. In any such action. . .....
