DRIVER NOT BLAMED rbomas Magers Exonerated by Coron a's Jury 1 Portland.' Thomas Magers, chauffeur for A. Welch, whose machine ran over and killed a 12-year- old boy In Portland, Tuesday, was exonerated from blame by the Coroner's Jury Wednesday af ternoon. The testimony went to show that the accident was unavoidable and that Magers had done everything In his power to avert it. The Oregonlan gives the following account of the sad affair: "Herman Heisig, a 12-year-o!d boy, was struck by an automobile at the intersection of East Morrison and East Sixth street yesterday after noon and died a few hours later at St. ; Vincent's Hospital. "From the story of Thomas Magers, the chauffeur, and several witnesses; it appears that the boy was riding on the rear of a transfer wagon which was going south on East Sixth street The automobile was going west on East Morrison street and the automo bile was brought to almost a stop to allow the wagon to pass. "When only a few feet from the ma chine, the boy suddenly Jumped from the wagon squarely in front of the au tomobile. The driver did not have time to stop his car but made an effort to swing to one side of him and almost succeeded. However, the rear wheel of the machine caught the boy and passed over his body. Magers brought the ma chine to a stop and with Robert Sprague, the only other occupant of the car, rushed back to the injured boy's assistance. He was hurried to the office of Dr. Ravenna Spurrier. On dis covering that the child was dangerous ly hurt. Dr. Spurrier had him removed to St Vincent's Hospital, where he died at 3 o'clock. "Mr. and Mra Charles Helsig, the boy's parents, who live at Fifty-sixth and Ash streets, were summoned to the hospital, but the boy expired be fore they reached his bedside. "The automobile which struck young Heisig is a large seven-passenger Pope-Hartford, and Is owned by Al bert Welch, an electrical contractor, who has offices In the Fenton build ing. "Magers was arrested last night by orders from the District Attorney's office, and will be held to appear at the Coroner's inquest, which will prob ably be held today. Magers has been in Portland about four months and has been driving for Welch for about one month. He Is a licensed chauffeur. His parents live at Dallas, Oregon. As nearly as the Observer has ever been able to ascertain, the only per mission from the city to the mill com pany to maintain and operate this ditch is found In a right-of-way l.cd recorded some 40 years ago, In which the city granted to one John Waymlre the right to dig and maintain a water ditch within the city limits for the pur pose of furnishing power for the oper ation of a grist mill.
