AFTER FIFTY YEARS Heirs Bring Suit to Gain Possession of Land. The suit of Thomas Crowley and others against Mrs. U. S. Grant to recover an undivided six-sevenths of the North half of the Andrew Mon roe Miller donation land claim of 640 acres near McCoy was tried before Judge Galloway, Wednesday, after noon. At the conclusion of the intro duction of evidence, the Judge took the case under advisement, to have oral arguments made In Salem and written briefs submitted. The plaintiffs are heirs of Monroe Miller's first wife, Margaret A. Miller, who died without issue In January, 1852, about six months after settle ment on the land was begun. The de fendant, Mrs. Grant, is the sole heir of Monroe Miller, being daughter by his second wife, to whom he was mar ried about 1854. Mrs. Grant claims the land by reason of adverse possession on the part of her father for more than fifty years before his death, which occurred in January, 1909. The defense is also made that the plaintiffs' claim Is stale and that they have been negligent In waiting so many years before commencing pro ceedings. The plaintiffs seeks to excuse their delay by showing that they were advised by attorneys many years ago that they could not recover any part of the land until after Mr. Miller's death. The case presents many Interesting questions, and the land In controversy is now very valuable. Thomas J. Hay-' ter, Cass Riggs, A. M. Holmes, Sol omon K. Crowley, James W. Edgar, James K. Sears and other prominent pioneer residents were called as Wit nesses, while old-time acquaintances of the parties were Interested spectators. Well Attended Mooting. .
