NO MAXIMUM PRICE For many yeara there has been a widespread impression In Oregon that the California and Oregon Railroad Company has no legal right to sell the land within the limits of Ms grant from the Government for more than $2.50 per acre. Desiring to investigate the correctness ot this opinion, X O. VanOrsdel, of this city, recently wrote to his brother, Hon. J. A. Van Orsdel, Assistant Attorney-General of the United States, for official inform ation on the subject. General Van Orsdel replies from hisofllocln Wash lngton as follows : "I received your letter some titne ago requesting me to investigate the conditions under which land grants were made to the California and Or egon Railroad Company. "This grant was made under act of Congress approved July 23, 18GG, for the purpose of constructing a line of road from the city of Portland to the Central Pacific Railroad In the Sacra mento valley In California. There was granted to the railroad company 'every alternate section of public lands not mineral designated by odd numbers to the amount of twenty al ternate sections per mile (ten on each side) of said railroad line.' "In other words, the railroad com pany was granted each alternate odd numbered section for 20 miles on each side of the line of railroad. There Is no limitation contained in the grant ns to the price for which these lands could be sold by the railroad com pany. There was, however, a further provision in the grant, aa follows : " 'And the sections and parts of sec tions of lands which shall remain In the United States within the limits of the aforesaid grant shall not be sold for less than doable Ithe minimum price of public lands when sold.' "The minimum price for the sale of public lands ever since has been 11.25 per acre. Therefore, the Government price within the limits of this railroad grant, and in fact, all other railroad grants, has been double the minimum price, or $2.50 per acre. That is prob ably where you got the impression of the requirement that the land should be sold at $2.50 per acre. But that provision has no reference whatever to the price that may be charged by the railroad company for the lands therein embraced. There is nothing contained in the grant to prohibit the railroad company from selling its land for the highest price that It can command. Hence there seems to be no foundation for the report that the company was required by the terms of the grant to sell its lands for $2.50 per acre. Song of the Legislator. Give up those passes? FAMILY REUNION Grandma Hinshaw's Seventy-Sixth Birthday an Occasion of Ulad Home-Coming. The Hinshaw family met In a re union at the home of their mother in North Dallas, Wednesday, in honor of her7Cth birthday. Eight children, twenty-five grandchildren and great grandchildren, and other relatives were present to enjoy the day, it being the first time all of the children had been together In 31 years. After par taking of a splendid dinner, -the mother and children went to Cher- rington's gallery and were photo graphed in a group. The children present were: Zimrl Hinshaw, of Falls City; Mrs Sarah Walling, of Portland; Tilghman and Anderson Hinshaw, of Gooseneck ; Avery and Zenas Hinshaw, of Mill Creek; H. Hinshaw, of McMinnville, and Ellas Hlushaw, of Dallas. Zirari, the oldest child, is 56 years of age, and Elias, the youngest, is 40. The child ren were all born in Polk county. All are enjoying the best of health. As proof of the health fulness of Polk county's climate, it might be added that the combined weight of the mother and eight children of this pio neer family reaches the handsome total of 1,655 pounds. Grandma Hinshaw was remem bered with many beautiful presents, a number of gifts having been sent by relatives who were unable to attend the reunion. Among the childrens gifts was a neat sum ot money.
