Polk County News 2A Polk County Itemizer-Observer • January 6, 2016 Polk County BOC to hold public State taxes start on hearing marijuana land uses recreational marijuana Citizens can comment on planning commission findings By Jolene Guzman The Itemizer-Observer POLK COUNTY — The Polk County Board of Com- missioners will hold a public hearing Jan. 13 on proposed land use regulations on medical and recreational marijuana. The board will consider and take comments on the proposal developed by plan- ning staff and reviewed by the Polk County Planning Commission during three previous meetings. Proposed amendments to the Polk County Zone Code will allow the county to im- plement House Bill 3400, the legislation that administers legal marijuana. Local jurisdictions are al- lowed to govern the “time, place and manner of med- ical and recreational mari- juana uses in certain zones.” The board may deliberate after the public hearing for select another date to delib- erate the issue, said Austin McGuigan, the community development director. Planning staff has recom- mended — and the planning commission accepted — al- lowing marijuana produc- tion on land zoned exclusive farm use (EFU) and other zones where farm use is al- lowed, including “farm/for- est,” (FF) “farm/forest over- GOVERNMENT lay,” (FFO) and “timber con- servation” (TC) zones. Areas zoned “light indus- trial” were selected for pro- cessing and wholesaling marijuana, and the Rickreall unincorporated community industrial zone (in the west- ern, eastern, and southern margins of Rickreall) for marijuana processing, wholesale use and marijua- na testing. Lands zoned light indus- trial are located within the urban growth boundaries of cities, an area planning staff believed was appropriate for processing and wholesaling activities. Retail and medical sales in the county (outside city lim- its) would be restricted to one area in the Northwest Polk County Community Commercial zone, near the unincorporated communi- ties of Grand Ronde, Fort Hill and Valley Junction. “Retail sales of marijuana and medical marijuana dis- pensaries are anticipated to occur primarily inside city limits where the greatest supply and concentration of retail space exist, as well at the largest markets for con- sumers,” said the planning staff report dated Dec. 8. Testimony from residents in the area suggested that area of the county has a mar- ket for a medical marijuana dispensary, the report said. “Staff found it unlikely that urban consumers would leave urban markets specifically for retail and medical marijuana items in Northwest Polk County,” the report read. Retail facilities to get licensing from OLCC in late 2016 Itemizer-Observer staf report SALEM — Medical mari- juana dispensaries started collecting a 25 percent tax on the retail price of recre- ational marijuana products on Monday. Dispensaries began sell- ing nontaxable limited recreational marijuana products — seeds, leaves, flowers and nonflowering plants — to those 21 years or older on Oct. 1, 2015, under Senate Bill 460. House Bill 2041 author- ized the tax that began Monday. The rate is in ef- fect for dispensary sales until Dec. 31. Toward the end of the 2015 Legislative Session, marijuana taxation shifted from the grower level to the point of sale. Administra- tion of that tax moved from the Oregon Liquor Control Commission to the Depart- ment of Revenue. OLCC plans to start issu- ing licenses to retail facili- ties in late 2016. At licensed retailers, con- sumers will be able to buy more types of recreational marijuana products, includ- ing immature plants, edi- bles, concentrates, extracts and topical products. The state Department of Revenue is not involved in the collection of local mari- juana taxes. After the Department of Revenue pays for its admin- istrative expenses, and the OLCC’s liquor fund loan is repaid, the revenue from recreational marijuana tax will be distributed as follows: • 40 percent to the Com- mon School Fund; • 20 percent to mental health, alcoholism, and drug services; • 15 percent to the Ore- gon State Police; • 10 percent to cities for local law enforcement; • 10 percent to counties for local law enforcement; • 5 percent to the Oregon Health Authority for alco- hol and drug abuse preven- tion and early intervention and treatment services. In 2015, the city of Inde- pendence passed an ordi- nance approving a 10 per- cent tax on recreational marijuana, originally planned to go into effect Oct. 1, 2015, the day recre- ational sales became legal. Finance Manager Gloria Butsch said the city decid- ed to hold off on imple- menting the tax because of the legislation that was in progress. Dallas and Falls City also approved taxes on the drug, but left it at 0 percent until after the law was more de- fined. Monmouth has no tax on marijuana.
