Prose cuting Attorney Brown said in part: Oregon’s Sunday closing law is much narrower in its appli cation and scope than most of the Sunday laws of the different states of the union. This law has been on our statutes since December, 1865, but was amended in 1*M),3 by excepting theatres from its op eration and was also amended ill 1901 by omitting barbers from its excepted class. 1 have been quot ed as saying that the city should enforce its own Sunday law and 1 repeat that if the city fathers de sire to enforce Sunday closing with exact justice to all, it will lie necessary to pass an ordinance under its charter and if the charter is not broad enough it can be amended by the extraordinary power now invested ill the city by the initiative and referendum. In order to illustrate the inequalities in the working of the state’s Sun day closing law, I call your at tention to the fact that Oregon’s Sunday law does not make the traffic in or the selling of goods, wares and merchandise a crime, hut simply makes it an offense to keep open certain enumerated places for the purpose of traffic or labor. Under the laws of the state of Oregon, it is not a crime to sell ice cream, sod a water, to bacco or cigars, etc., upon Sunday, but it is a crime to keep open,a store or shop upon that day for the purpose of traffic. Under the state law it would be an offense for it to keep open ujxm Sunday for the purpose of traffic although it sold no books and only sold ice cream and soda water, for the reason that such sale would lie made in a place prohibited by the law. In the store of a Drug Co., there is also a soda fountain and ice creatn is sold. Under our state law the Drug Company could sell ice creatn and soda water upon the Sabbath and it would be no violation of the law, for the reason that the sale of the goods is not against the statute and a druggist has a right to keep open his drug store on Sunday. Cigars and to bacco could also be sold in drug stores upon Sunday and it would lie no violation of the law. In or der to further illustrate my mean ing and reason for saving that there should lie a city ordinance covering this matter, I will state that some of our hotels carry cigars for sale. Under the state law cigar stores must close on Sunday, but the hotel keeper can sell cigars on Sunday, and not violate any law of Oregon, for the reason t h a t it is of no offense to s e l l tobacco a n d cigars upon Sunday, and hotels are lawfully open upon that day. In other words, the law applies to certain places of business enum erated in the statutes and not to the sale of commodities. There can lie no misunderstanding of the construction of the law if a person will carefully read it, which is as follows: "If any |ierson shall keep open any store, shop or grocery, bowl ing alley, billiard room or tippling house, for the purpose of labor or traffic, or any place of amusement, on the first day of the week com monly called Sunday, or the laird’s day, such iarson upon con viction thereof shall lie punished by a fine not less than $5 and not more than $.50: Provided, how- DOWNWARD COURSE A. 11.
