OWNERSHIP OF THE IIKLUNA Judge Gilbert listens to Argu meutson Jennings Bros.' De- nutrrer. The now somewhat celebrated case of G. G. Warner vs Jennings Bros., involving the ownership of the Helena mine, in the Uohemia district, came up before Judge Gilbert in the United States cir cuit court yesterday for argument ... on a demurrer to tne complaint. Under the United States statutes Warner, an adverse claimant, , . .. . ' was required to bring suit on Ins. . , . r. , . ,. r I adverse claim, filed in the Rose- , burg land office August 1 1 o 1099, within 30 days from the date of filing. It appears that he did not bring action in support of his ad verse until November 23, 1899, 72 days later than required. The case came before Judge Gilbert on de murrer to Warner's complaint, on this ground, and the demurrer was argued and submitted. If the demurrer is sustained, it i ,!11 nrm!t !, mnrl-Lirr nf llo tinn. . mill erected on the mine bj Jen nings Bros., and will create great activity in the district, as well as settling the question as to whether persons, in acquiring title to mineral lands must comply with the laws of congress, or not. Jennings Bros, have expended 25, 000 in putting up a mill, and run ning tunnels and drifts on the Helena mine, and it is claimed have been held up by what is known in mining camps as the "notice man." This is the mine from which persons attempting to make a survey were run off some time ago by armed men, and made record time in getting away. It is reported that one of the fugitives in the wild rush down the mountain stumbled on a rabbit and yelled: "Get out of my way, you rabbit, and give the road to a man that can run." NEW VARIETY OF WHEAT. J. M. Shelly, of the Eugene flour mill, has received from Idaho, a sample of what is called corn wheat. It resembles a very much elongated grain of wheat and has the combined taste of wheat and corn. It is claimed that corn wheat will out yield corn and that it has wonderful fattening qualtties being pronounced just the thing for cattle and hogs. It is sown the same as wheat and yields heavily. The straw is oily and makes fairly good hay. If it possesses the good qualities claimed lor it, cattle anu stock: raisers should go to raising it.
