C ossoi . io m io n oi C oM iiii ors C. oiipohations Two or more contiguous cities and towns may become consolidated into one corporation after proceedings had as roquired in this section. The council or other legislative hody of either of such corpora tions shall, upon receiving a petition therefor signed by not less than one-tenth of the qualified voters of each of such corporations, as shown by the whole number of votes cast at the last regular municipal election held in each of such corporations, submit to the elec tors of each of such corporations the question whether such corporations shall be consolidated into one corporation. Such councils or legislative bodies shall designate a dav upon which a special election shall lie held in each of such corporations, or submit the same al the general city election, to determine whether such consolida tion shall I k - effected, and shall give writtten notice thereof to the council or other legislative body of each of the other such corporations, which notice shall designate the name ol the proposed new corporation. It shall thereupon la- the duty of such council or legislative hody ol each of the corporations so proposed to la- consolidated to give notice of sticli election by publication in a newspaper of general circulation in such corporation for the period of four weeks prior to such election. Such notice shall distinctly stale Ihe proposition lo he so submitted, the mime of the corporations so proposed lo la- consolidated, the name of the proposed new corporation, ami shall invite the electors to vote upon such proposition, by placing upon their ballots the words, "fo r consolidation” or “ against consolidation,” or words equivalent thereto. The councils or legislative bodies of each of such corporations shall meet in joint con vention at the usual place of meeting of the council or legislative body of (bat one of the corporations having tin- largest population, shown by the last stall- census, on the Monday next succeeding the day of stieli election at one o clock I*. M., and proceed to canvass the votes cast thereat. The votes cast in each of such corporations shall he canvassed separately, and if it shall appear upon such canvass that a majority of the votes cast in eaeli of such corporations is for consolidation, such joint convention, hv an order entered upon their minutes, shall cause the clerk, or other officer perform ing the duties of clerk of the council or legislative body, at whose place of meeting su«*h joint convention is held, to make a certified abstract of such votes, which ab stract shall show the whole number of electors voting at such election in each of such corporations, the number of votes cast in each for consolidation, and tin- number‘ of votes cast in each against consolidation. Such abstract shall be recorded upon the records of tin- council or legislative body of each of such corporations; and immedi- nlely upon the recording thereof it shall he the duly of tin* clerk, or other ollicer per forming the duties of elerk of each council or legislative hody, to transmit to the Sec retary of State a certified copy of such abstract. Immediately upon such filing the charter of the town or city having the smaller number of legal voters as determined hv the last general election shall thereupon determine, cease, and lie repealed, and the tenure of oilier of Ihe oltieers of said smaller municipality shall cease and determine, and Ihe charter laws and ordinances of the larger «if said cities or towns to he deter mined as above provided for shall continue in effect and shall thereupon and there after govern such consolidated municipalities until changed or amended in accordance with the laws of the Stale of Oregon and tile tenure of oflicc of its oltieers shall con tinue thereunder. Section 2. Ami the said consolidated municipality shall succeed to all the property rights and franchises and shall assume and pay all liabilities of the munici pality thus consolidated. Section 3. And all consolidations or attempted consolidations of cities or towns heretofore made under the provisions of Title XXVI, Lord’s Oregon Laws, are hereby ratified, continued, legtdi/.ed and declared valid as of the date of such con solidation or attempted consolidation. F ormation of N ew C ounties - Section -1. New counties may be created from territory of one or more old couiili. s of Ib is state, provided any such county from which territory is thus taken shall have remaining an area of not (ess than .'»(Ml square miles, a population of not less than 2000 and properly of not less than v2.<>00,000 assessed valuation, in substantially the manner following: Not less than 30 per cent of the legal voters residing in any district having an area of not less Ilian ."»00 square miles, a population of not less than 2000 people, and prop erty of an assessed valuation of not less than >-2.000,000, shall tile their petition for the creation of such new county and deposit such sum of lawful money with the Secre tary of State as the (inventor shall estimate to he necessary to pay the expenses of the proceedings. The total vole east within said territory for representatives in Congress at the last preceding general election shall lie the basis on which the number of peti tioners necessary shall la- computed. Said petition shall conform in its verification and general features as nearly as may be to the laws governing initiative petitions and shall contain the following information, where applicable: I. The name and location of the temporary county seat. II. The name of the proposed county and the description of its proposed boun daries. ■ III. The titles of oltieers required. IV. Approximately the number of legtd voters, the number of children of school age, and the population resident in the described territory. V. Approximately Hi«* number of votes east therein for representative in Con gress at the last preceding general election. VI. Approximately the area and assessed valuation thereof. VII. The whole amount of taxes now paid by said territory, annually (exclu sive of special district levies for school and roads), and the estimated amount that will he necessary if the new county be created. Section 5. For four weeks immediately before tiling such petition, the petition ers or a committee of their number shall give printed notice, by advertisement in two newspapers of general circulation within the territory affected, of their intention lo fib* said petition, and of the proposed boundaries of said county; and they shall tile with their petition proof of such publication, as in tlu* case of service of summons by publication. Section 6. The Secretary of State shall notify the (iovernor when the petitioners have complied with this act, and within thirty days thereafter the (iovernor shall appoint three commissioners, each of whom shall make oath that he is not a resident, property owner, nor a taxpayer or interested directly or indirectly within the terri tory of the proposed new county or of any county from which said new county is being created, and one of whom shall he a practicing surveyor and civil engineer. Said commissioners shall subscribe ami Hie with the Secretary of State an oath of office declaring that they will faithfully and impartially perform their duties to the best of their ability. After the commission shall have organized, it shall give notice by publication once a week for four successive weeks in a newspaper of general circulation in the counties affected, of the time and place at which the commission will meet and in vestigate facts and hear arguments for or against the creation of the said new county.
