An Ordinance to Provide for Licensing and Regulating Bar-Rooms and Drinking Shop a Within The Corporate Limits ofThe City or Astoria. The City of Astoria does ordain as follews: Section 1. That no person or persons shall in the City of Astoria,CIatsop coun ty, Oregon, either directly or indirectly, in person or by another sell, barter or deliver, or knowingly permit to be sold, bartered or delivered, lor or on his or their account, any wine, malt or spiritu ous liquors to be drank on the premises ownci or occupied by him or them, without first obtaining a license so to do. in tho manner in this ordinance hereinafter provided. Any person vio lating any of the provisions of this sec tion shall, upon conviction thereof be fore tho Auditor and Police Judge be fined not less than twenty-five nor more than one hundred dollars, and be im ptisoned in the city jail until such fine be paid, not to exceed twenty days. And it is hereby made the duty of the Chief of Police and of each policeman or the uity ot Astoria to mane com plaint to the City Attorney of each and every person for any violation of the provisions of this ordinance. See. 2. The applicant shall present with such bond and petition a rt ceipt of the treasurer for the amount of monev deposited for sucli license. Sec. 4. The petition required by this ordinance shall state: 1st. The ndme of the applicant. 2d. Whether such applicant iias be fore held or holds at the time of appli cation a license, and if so, at what uate such license has or does expire. Sd. At what dates such applicant de sires such license to begin and expire, and the place where such liquors are to he sold. Such petition shall be verified by the applicant or if more than one by at least one of such applicants, stating that such petition is true. tec. 5. The receipt of the treasurer mentioned in section 3 of this ordinance shall state that the amount paid by uch applicant is paid for a liquor li cense to be refunded in case the Com mon Council shall refuse to grant the petition of the applicant, otherwise upon the issuing ot such license to go into the funds o the city. Sec.C. Upon the granting of such petition by the Common Council the Mayor shall examine the bond of the applicant and either approve or disap prove the same. Sec". Upon the provisions of this ordinance being fully complied with the Auditor and Police Judge shall is sue such license to such applicant. See. 8. The bond to be given by the applicant, as provided in this ordinance, in case of a violation of any of its pro visions and conditions shall be liable to be prosecuted therefor in a civil action, and it shall be the duty of the Auditor and Police Judge of the city of Astoria to prosecute the bond given by sucli ap plicant, for any violations of its condi tions. See. 9. Any keeper of a bar-room or drinking shop who shall permit any breach of tho peace or disturbance of the public order or decorum, by noisy or disorderly conduct on the premises, when it is in his or her power to pie vent the same or who shall sell or give any intoxicating liquor to any persou already intoxicated, or to any person under the age of legal majority, or who shall allow or permit anS' minor to re main in or about any bar-room or drink ing shop under his or hercontrol, shall be deemed guilty of a misdemeanor, and upon conviction thereof before the Po lice court, be fined not less than twenty-five nor more than one hundred dol lars, or by imprisonment in the city jail, not less than twelve nor more lhan twenty days, and shall forfeit the li cense to sucli bar-room or drinking shop. Sec. 10. Any keeper of a bar-room or drinking shop who shall permit or em ploy any woman to act as waitress or oar-tender, or to sing or dance, or to serve in any other capacity in such bar room or drinking shop or who shall em ploy any person to sing or dance in such bar room or drinking shop, or who shall permit ahy theatrical or minstrel show, exhibition or concert to take place in such bar-room or drinking shop, or who shall allow or permit any minor to be or remain in any theater or place of amusement in which intoxicating liquors are sold, shall be deemed guilty of a misdemeanor, and upon conviction thereof before the Police court, shall be fined not less than ten nor more than ono hundred dollars, or by imprison ment in the city jail not less than five nor more than twenty days, or both, in the discretion of ths ccur, and shall torfeit the license to sucn bar-room or drinking shop. sec. 11. Eacli and every place here any wines, malt or spirituous liquors are sold, bartered or delivered to be drank on the premisesj shall be deemed to be a bar-room or drinking shop un der the provisions of this ordinance. Sec. 12. Each and every person hav ing a license under the provisions of this ordinance shall exhibit the same at all times, while the same is in force, in his or their place of business. Any per son violating the provisions of this sec tion shall upon conviction thereof be lore the Police court be fined not to ex ceed fifty dollars or by imprisonment till such fine is paid not to exceed twen ty days. Sec 13. That ordinance No. 870, en titled "An ordinance amending section 2 of ordinance No. &S7" approved De cember 23d, 1885, and ordinance No. 872, entitled "An ordinance providing for the execution of a bond by any one wishing to obtain a license to sell spir ituous liquors," approved January 20th, 1880, and ordinance No. 932, entitled 'An ordinance amending ordinance No. 587, entitled an ordinance to pro vide for licensing and regulating bar rooms and drinking shops within the corporate limits of tho city of As-toria, Clatsop county, Oregon, approved No vember 10th, 1880, and ordinance No. 587, entitled "An ordinance to provide for licensing and regulating bar-rooms and drinking shops within the corpor ate limits ot the city of Astoria.
