ASTORIA, OREGON: SATURDAY- AUGUST IS, 1S48 Trial by Jury. The jury, like everything else, will on the whole reflect the aver age character of a people. Make the people better and better juries will be the result. Yrlrdfig Oregoniim. And that is about the fact. Iconoclastic tendencies may weak en the popular regard for the jury system, but to correct its abuse will be better than to decry a sys tem that exists because it cannot well be supplanted. Numberless have been the suggestions con cerning different devices to decide questions at issue, and most glar ing are the deficiencies that mar the workings of our juryT system, but like the pen with which we write, or the needle with which we sew, but little improvement has been made for a thousand years, and the best that can be said of them is that they are better than the appliances whicii they super ceded. The trial by jury means an open and public trial before twelve im partial men, temporarily selected from the mass of their fellow citi zens, and presided over by a mag istrate; their function is, undr his direction, to delcrmmc(in Oregon) by a unanimous verdict, in civil cases, such issues of fact as are submitted by the court to their de cision: in criminal cases to find the guilt or innocence of the ac cused by a general verdict of guilty or not guilty. In theory it is a splendid scheme: in practice, as the present session of the court for Clatsop county sadly demon strates, it is a failure. But while we condemn in part the pernicious tendency of a jury to disregard facts and pervert per sonal action, it must be remem bered, in general, that there are necessary adjuncts. A good jury requires an intelligent, discrimi nating judge: it requires good material in the composition of the jury itself. Here, m our opinion, is the grout defect, the fatal weakness. We all shrink from jury duty; no man whose time is worth any thing wants to sit on a jur'; all sorts of dodges and excuses are used and made to shirk the dis tasteful duty; it is human nature, but it is not right. The result, as airy one must see, is to allow men to naturally fill places in the jury box that a man in his private busi ness would sometimes hesitate about intrusting with business in terests. "What man that reads this but recognizes the truth? We have known instances where men of good standing and respectabili ty, and more than ordinary consci entiousness have put a little mon ey where it would do the most good in the hope of keeping off tho jury list. Yc arc talking now of something that occurred a thou sand miles from here, and mention it to illustrate the feeling that the average citizen has toward serving on a jury. This is the great trouble, and till men take a pride in this matter, till men can be in duced to look upon it as a matter of business interest, and essential to their individual and communi ty prosperity, the jury system of the United States will be a re proach and a discredit to our civi lization. It was noted in Australia, in her convict days, that the ticket-of-lcavcrs who went into trade were much more punctiliously hon est than the average tradesman. They felt that they were the ob jects of jealous notice, and that numbers -were waiting to catch them tripping,and exclaim, "Didn't I tell you so?" Looking at the heavy percentage of these men who become exemplary citizens and fathers of worthy families, it is a matter for profound regret that the system had to be aban doned. The convict in England to-day is, as here, continually driv en back against his better self into crime and breeds a criminal fami ly. Australia to-day has thousands of citizens wealthy, honored, and highly educated, who but for their fathers having been sent to the an tipodes would be thieves and out casts. The drive around Smith's Point is in a very fair condition, but the hill opposite the Seaside cannery should be avoided. It is too steep by far. It might be well to change the grade of that point. Lame Argument. Dir. Hamkoxd in a recent article in the JFortt. American Itevictr, declared that woman's organization incapacitates her from telling the truth, citing in illustra tion that she will begin by telling ber doctor that she hasn't eaten am'thing for breakfast and after cross-examination admits a cup of coffee, a roll, and an egg, which "wasn't eating anything.5' After such ungallant aud untruthful as sertion Dr. Hammond proceeds lo liken the brain of women to that of the lower animals, and to de duce from a supposed inferiority of quantity and quality of what he calls "the mind-producing organ," woman's unfitness to exercise equal political rights. Man's brain is larger and superior in structure, therefore he has more mind. To be sure, in proportion to the weight of the body, there is very little difference between the sexes, but that fact is quickly brushed aside. The fact that j some very unintcllectual men have very heavy brains, and that some very intellectual men (like Emer son and Gamhetta) have very J small ones, is ignored; and thej learned doctor remands woman loj political subjection by jxmipous parade of weights and measures. 1 Indeed, we wonder tliat Dr. Ham mond does not propose to abolish republican government altogether, i and to substitute for suffrage a civil service examination to ascer tain the comparative size and structure of brain. T'pon his theory craniology should take the place of political science. -AVc should award the presidency to the possessor of the largest skull, and choose our governors, congresses and legisla tures by superior dimensions of heads, certified by a board of ex- aminers presided over by the il lustrious discoverer. There arc plenty of arguments against wo man suffrage, just as there were against abolition, but such at tempts as Dr. Hammond's, even though he gain an audience in the JRecktr, cannot injure the cause very much.
