ed by the Hayward and Pixie.

The Elder landed at G. W.
Hume's dock yesterday in .consequence
of having so much freight for Mr.
Hume, who was also himself a passen
ger. The steamer left 212h tons for
Astoria.
During the absence wf.Mr Carl
Adler people are invited to call at his
store and help themselves to whatever
they choose, at bed-rock prices. His
present stock will be reduced to make
room for a large assortment in new
lines of goods.
Sabbath being the regular ap
pointment of Rev. E. N. Condit on
Clatsop plains, the usual congrega
tional prayer meeting will be beld in
the Presbyterian Hall, at 11 o'clock.
Sabbath school at noon. All are
cordiallv invited. No sevices in thel
evening.
By boring a hole through a silver
dollar and tying it to a tag a Connec
ticut nian sent it through the mail for
ti cent, whereas if he had pnt it in an
envelope it would have cost him three
cents. No one but a New Englander
would have thought of such a device,
and it is this prompt grappling with
the situation that gives New England
its mighty influence upon the world.

Pursuant to a cull to all fishermen
opposed to the license law to meet at
Metropolitan hall, on March 20th,
1879, at 7:30 o'clock, the Astoria Brass
Band discoursed some line music in
front of the hall.
The President Mr. J. G. Robeson
kindly thanked them on behalf of the
fishermen of the Columbia river for
V their good will and sympathy, and that
it would be well remembered.
The meeting was then called to or
der, and the object stated to be to
hear the opinion of Hon. E. D. Shat
tuck, and other matters of importance.
The committee then reported the
business done by them, and it was
moved and seconded that the report
be accepted. Carried.
The opinion of Hon. E. D. Shattuck
was then read and listened to with
marked attention.
The opinion is published in another
column. Ei.
It was then moved and seconded
that the opinion be accepted as final.
Sir. Zaspel, asked the committee
what was said about the right to tax
a man for laboring, or for taking or
depriving him of the use of his pro
perty. Mr. Weber in explanation stated
tha those points were not mentioned
ui the opinion, aim were prooauiy
doubtful, and offered to explain them
to the best of his ability, and referred
to the general laws of Oregon, page
13: and to the constitution of the
United States, Art. 1, Sees. 9, 4, which
says:
No capitation or other direct tax
shall be laid, unless in proportion to
the census or other enumeration here
inbefore directed to be taken.
Also on page 22; Art. 4, Sec 2.
"The citizens of each state shall be en
titled to all privileges and immunities
of citizens in the several states,"" and
refered to footmark 5. This is con
lined to those priviliges which are, in
their nature, fundamental; which be
long, of right, to the citizens of all
free governments, and which have, m at
all times been enjoTed by the citizens
of the ' several states which compose
this Union, from the time of their
independence, and among other rights
under this head an exemption from
higher taxes and impositions than are
paid br the citizens of the state. And
on page 29; amendment of the consti
tution of the United States, article 5,
last paragraph which reads as follews:
"Nor shall private property be taken
for public use, without just compen
sation." In footmark 5, relating to this we
find: "Private property may be taken
for public use, by allowing the owners
a reasonable equivalent." Calder vs.
Ball, 3 Dall 400. And further it says:
"By the geaeral law of European na
tions, and the common law of England
it was a qualification of the right of
eminent domain, that compensation
should be made for private property
taken or sacrificed for public use;"
and the coastitutional provisions of
the stiie aud United States, which
declare that "private property shall
not be taken tor public use without
just compensation," were intended to
establish this principle beyond legis
lative control.
It is not necessary that property
should be absolutly taken in the nar
rowest, sense oi mat word, to fcnnir
the case within the protection of this
pro vision; there luay be such serious
interruption to the common and neces
sary use of property, as will be equiva
lent to a taking; within the mean
ing of the constitution, Pumpley v.
Green Bay Co. 13 Wall, 1.7G.
And said, further, that not with
standing the opinion of the Hon. EL
u. onattucK, ne tnougui that our
rights come within the provisions of the
constitution, .and as these points were
not plainly placed in the opinion he
would respectfully submit them to the
consideration of the meeting.
The motion was then put to the
meeting and was lost
Mr. A. A. Cleveland then addressed
the meeting and said he w;is opposed
to any violent action, but in favor of
testing law in a legal way or to dismiss
the case altogether, and if this law
stands, "coming events cast their
shadows before," the next step would
be to limit the number of licenses to be
issued, and then a mau who owned
his own boat and net would have to
emigrate to some more genial clime.
He appealed to the honor of all men
to stand by their rights, and called at
tention to onr forefathers, how they
stood shoulder to shoulder, and ad
vised fishermen to do so also, and re
peated the following lines; That he
who knows his rights and will not toil
awd trouble brave, is not worthy to be a
freeman and is at best but a slave."
Mr J. Williams next spoke and
censured the lack of spirit shown by a
great many fishermen u stand by
their rights, and did not think it man
ly to let a. few carry the burden for
the lienefit of the many, and that it
was the duty of every citizen and
fishertaan, to assist to the best of his
ability, to defeat so unjust and un
reasonable a law. It was moved and
seconded that all in favor of some
action remain in the hall, on the con
trary to vacate, Carried.
Moved and seconded to all to come
forward and contribute to the best of
their ability, and give their names.
Carried.
Moved and seconded that all willing
to contribute to this fund to step for
ward and record their names. Carried.
Moved and seconded that the
treasurer make a report of finances,
carried.

Mr. J. Williams then addressed the
meeting and said he did not like the
opinion obtained, and advised a test
case,and that some able attorney be em
ployed to defend the case for us.
Moved and seconded that some
other lawyer be obtained.
After some discussion that it would
not advance the interests, as experi
ence showed, the motion was with
drawn. Moved that the committee select
some able attorney to test the law;
carried.
Moved that the committee use their
discretion, when the test case .shall be
made; carried.
Mr. A. A. Cleveland, then tender
ed his resignation as a member of that
committee, owing to having other
pressing business; motion to accerjt
was carried.
Moved and seconded that Mr. Geo.
Williams be appointed to fill the va
cancy, unanimously carried.
Moved and seconded that a vote
of thanks be tendered Mr. A. A.
Cleveland, and other members of the
committee; carried.
Moved and seconded that this meet
ing do now adjourn; carried.

Following is a cop of the pro
test of citizens of Astoria, respect
ing certain outrages, which we res
pectfully submit to readers of The
Astorian. The matter will come
before the Council this evening,
and the respectability of the signa
tures, as well as the number of the
names, will entitle it to respectful
attention. It occurs to us that if
teams can pass up and down Alain
street in the mud, a man on a horse
should be able to do so.

your Hon. body, at the last mooting thereof,
ordered the discontinuance of tho street lamp
at tho corner ot Main and Eighth streets, for
tho reason that certain citizens and residents
of that locality had presented a petition re
quiring your intervention to prevent the lamp
lighter from riding on the side-walks, in con
travention of the ordinances of tho city there
by endangering the lives of women and chil
dren, whreh wo understand has been tho case,
do hcroby protest agaiast the action so taken
at your lost meeting, and learning that other
citizens can go up Main steeet with horses
and wzgons, without riding on the sidewalks,
and deeming it nothing but justice to tho resi
dents of the locality of said lamp that they
should bo protected by having said lamp lit,
the same us other parts of tho city, wo request
thatsuch order of discontinuance bo sot asido,
that said lamp shall bo lighted as heretofore,
and tbat tho lamii-lighter bo required to con
form to tho ordinances of tho city, tho samo
