.Salmon and Legislation.
Following is the bill p;issed by the
-territorial assembly as a substitute for
the board of trade bill, to encourage
the establishment of salmon liatching
ihouses on the waters of the Columbia
river:
Septiox 1. Tliat a fish commissioner
for the Columbia river and its tributary
water, be appointed by the governor by
and with the advice and consent of the
council, who .shall hold his office for two
years, and until his successor isappoint
. ed and qualified, who shall be a resident
of one of the counties bordering upon
the said river. Said commissioner snail
exercise a general supervision over the
."fisheries of said river within this terri
tory, consider and report upon the intro
ductioiu production and culture of food
"fish, especially the salmon, co-operate
with the fish commission of the state of
Oregon, make report to the legislative
assembly at each biennial session there
of, as hereinafter more particularly pre
scribed, and perform such other duties
.as may be hereinafter imposed. Before
entering upon his duties he .shall exe
cute a bond to the territory of Washing
ton, with two or more sureties, to be
approved by the judge of the second ju
dicial district, in the sum of ;?10,)0Q, con
ditioned for the faithful performance of
his official duties and the disbursement
according to law of all money coming
into his hands. Said commissioner may
appoint deputies, not to exceed one for
each county bordering upon said Colum
bia river, for whose action he sluill be
responsible upon his official bond.
Srcc. 1. Tt shall not be lawful to take
or fish for salmon far traffic, barter or
sale in the, waters of the Columbia river
and its tributaries with either of the ap
pliance regulated and prescribed by the
act entitled "An act regulating .salmon
fisheries in the waters of the Columbia
river," without first having obtained a li
cense therefor. The rates of said license
shall be as follews: The owner or own
ers of each and every boat engaged in
taking or catching salmon upoai said
river and its tributaries with n gill net
shall pay ten dollars for a limise for one
season. For each and every seine used
in fishing for salmon upon .said waters,
the owner or owm rs shall pay for such
license for one season ten dollars. For
every weir or trap used in catching or
taking salmon on said river or its tribu
taries, the owner or owners shall pay for
a license for a season fifty dollars. For
each and every dip net used for fishing
for salmon in said river and its tributa
ries, the owner or owners shall pay an
annual license of two dollars. Each and
every net tender or fisherman fishing or
taking salmon with a gill net shall be
reejuircd to pay five dollars for a license

shall be good for the whole season upon
any of the waters of the said Columbia
river.
Sec. o. The .licenses aforesaid shall
be prepared by the said fish commission
er, attested by his offinaLseal. The com
missioner snail register the number
thereof, to whom issued and for what
purpose. Owners of boats receiving li
cense shall cause to be painted in plain,
conspicuous figures upon both sides of
the outside of the stern of their respec
tive boats, three indies below the wash
board, the number borne upon the li
cense of said boat. A failure or neglect
to paint such register number upon such
boat as herein prescribed, shall subject
the owner or owners thereof to a penalty
of ten dollars, to be recovered in an ac
tion before a justice of tue peace. The
commissioner shall be entitled to charge
the following fees, viz: Twenty-five
cents for each license to a fisherman,
fifty cents for a boat, one dollar for a
seine or fish trap of any kind, and twen-t-fivc
cents for a dip" net, which fees
shall be reserved out of the moneys by
. him received for the licenses issued.
Sec. 4. Any person or persons who bv
thc foregoing provisions of this act shall
be required to take out a license, shall do
such act or use such boat, seine, gill net,
weir or trap, dip net or fish with gill net
without having first taken out such li
cense therefor as herein required, shall
be liable to a penalty of fifty dollars for
eacli and every offense, and shall more
over be required to pay the. license fee
required by law, to be recovered before a
justice of "the peace, or other court of
competent jurisdiction.
Sec. Tk Any proprietor, managing
agent, foreman or employe in charge of
any cannery upon the said Columbia
river, employing a fisherman to whom
no license has been issued, or knowingly
purchasing salmon from any person
using a boat, .seine, net or fish trap for
which a license is required, without first
having taken out said license, .shall be
liable to a penalty of fifty dollars for
each and every offense, to be recovered
before a justice of the peace.
Secji. All moneys received for license,
herein referred to excepting the fees for
issuing the same shall constitute a fund
and be exclusively applied to the assis
tance of a hatching house or houses on
the said Columbia river or its tributaries.
Any person or persons, or corporated
company who shall furnish satisfactory
evidence to the said fish commissioner
that a liatching house or houses has or
have been established by such person or
persons or company, and have actually
hatched salmon with which said Colum
bia river is or has been stocked and sup
plied, the said commissioner shall forth
with pay over to such person or persons
or company the said fluids: Provided,
if there be "two or more of such hatching
houses in operation by different persons
or companies, then such funds snail be
distributed pro rata according to the
number of hatched salmon.
Sec. 7. The person or persons making
complaint of any violation of the provis
ions of this act, by the failure to take
out license as herein required, or to do
and perform other acts as herein pre
scribed, shall upon the conviction of the
party accused, be entitled to one-half of
. the penalty recovered. All tines and
penalties hereby or herein, imposed,
shall be enforced and collected as other
fines and penalties are by law enforced

other officers receiving such fines or pen-
alties. after payment of one half of such
penalty so collected to the complainant,
shall forthwith pay the remaining half
to the fish commissioner to be applied to
the establishment of or assistance of
hatching houses, as provided in section
(5 of this act.
Sec. . The said fish commissioner
shall biennially, on the l.'ith day of Sep
tember, make a report to the governor,
to be submitted to the legislative assem
bly, which report shall exhibit the
amount of moneys received from licen
ses, penalties, and other sources, and
how applied; the condition, progress,
success, etc., of the hatching houses,
hints, suggestions or information on the
subject of food-fish propagation, and
such matter as may be valuable in legis
tion for the protection or preservation of
food-fishes, and the salmon fisheries of
the Columbia river.
Sec. 1). No section, proviso, or part of
this act shall be considered as valid or
operative until the legislature of the
state of Oregon shall enact a similar sec
tion, proviso, or act, in whole or in part
and from and after the passing of such
a law by the state of Oregon, such parts
hereof as shall be so enacted, shall im
mediately go into full force and effect.
And the" governor of this territory is
hereby requested to transmit an attested
copy of 'this act to the governor of the
state of Oregon, requesting him to sub
mit it to the legislature of that state.
JtfEWS OF THE MORNING.
A torpedo ship exploded in the
harbor at Buenos A3rres on vhe .12th,
killing 11 persons.
The British bark Swordfish' was
sold at auction (a wreck) at Victoria,
on the 10th, for $1,050.
A destructive fire occurred in a
bonded warehouse in San Francisco on
the 12th. Losses $44,000 over and
above salvage.
The 40-days agony at Olympia has
ended. Again peace reignsin the cap
"itol, and the bats and owls can resume
their wonted places.
A dispatch from Franklin, Illi
nois, on the 12th,states that the night
before a man named Jfehn H. Duncan
being refused liquor at the drug store
of Wright Bros., returned, after the
store was closed, and entered through
the back window, distributed a keg of
powder over the floor, turned the taps
of the coal oil barrels and set the
whole on tire and attempted to escape,
but before he had succeeded a terific
explosion occurred entirely demolish
ing the store and setting lire to an ad
joining grocery, which was also de
stroyed. Duncan was fatally burned.
Loss $15,000, insurance $3,500.

lem on the 8tk instant
The wharf at Crescent city was
washed away on the 5th by a heavy
sea. Loss $7,000. The portion of the
wharf demolished was about the same
place that was washed away two years
ago, this time four hundred and forty
three feet gave away.

"Whereas the city of Astoria has by or
dinance directed and authorized the issuance

three years after date, with interest at the
rate of ten per cent, per annum, payable
quarterly, and payable in U. S. gold coin,
which bonds are to be receivable for all spe
cial raxes, and are issued in payment of the
contract for the buildini: of the City Hall and
.Tail, and at the times as follows : One third
of even date herewith, one third when the
building is enclosed and the remaining one
third when the building is finished and ac
cepted. Now. therefore we the undersigned.
Trustees appointed for the purpose, hereby
give public notice that we shall receive pro
posals for said bonds from now until Thurs
day, November 22, 1S77, at 12 o'clock m., at
the store of either one of the understood
in Astoria. Oregon. Proposals will be
received for bonds from SM up to the full
amount and must state the highest sum on
the dollar parties will lake the same for. No
proposals will be entertained at less than i2
cents. Bonds to be paid for and delivered as
issued by the city.
