Notwithstanding the fact that
the attorneys for Antone Wolte,
plaintiff in the suit brought against
the county judge to restrain him
from issuing the prohibition pro
clamation tomorrow, made a spec
ial flying trip to Heppner yester
day armed with the complaint and
petition aud injuction for the re
straining order Judge Bean refnsed
to issue thetemporary order as
prayed for by the plaintiff and
there will be nothing to prevent
Judge Gilliland of the county court
from issuinc the proclamation to
day putting into effect the prohi
bition in Umatilla county as voted
at the recent election.
Ihe complaint in this suit was
filed yesterday morning by Eichard
& Raley and Lowell & iVinters,
and immediately after the filing
Messrs. Richards and Winter char
tered an automobile and hit the
hill road for Heppner to present
the matter to Judge Bean who is
holding court in that county this
week and if possible to get an in-
juction from the court restraining
Judge Gilliland from issuing the
proclamation which is required by
the local option law and which is
due today.
The Pendieton attorneys did not
get to present their case to Judge
Bean until about 5 o'clock yester
day afternoon and after tdey had
set the merits of their contentions
on behalf of the bhIoou interests
before the court and asked for the
restraining order the court refused
to grant it, but promised the at
torneys that he would give them a
hearing; on the merits before the!
first of July, when the saloons must
