In case the owner, bis agent or representative, and such per son so taking up such animal or animals shall be unable to a:ree as to the amount justly due for keeping the same, then thev shall select three disinterested and competent persons as arbitrators, who may swear witnesses, hear testi mony, inspect the stock and premises. and decide the matter, which decision shall be final. Should the owner ot any such animals, or his agent or represent ative, appear at any time after such Bale and prior to the filing of said re port with the county clerk, and furnish satisfactory proof of Lis ri. Ht thereto, such person so taking up bp id stock shall if required, furnish him a true statement and report in writing of the j proceedings, giving description of such animal or animals, date of sale, date and manner of giving notice, the costs and expenses thereof, the amount o damages, if any, and pay over any bal ance remaining from such sale, taking such claimant or owner's receipt there for, and in such case it shall be un necessary to 61e any report with the county clerk.
