Hitchcock and E. W. Bartlett, register
of the LaGrande land office will be of
interest to intending homesteaders. The
desprt land prob'em is fully explained,
and coming from the government can
be relied upon as trustworthy.

Gentlemen :-l herewith enclose j ou
a copy of letter of instructions received
at this office relating to the withdrawal
of certain lands in my district, nnder
the act of June 17, 1902 ; the lands being
withdrawn temporarily for the purpose
of investigation, as set forth in the en
dowed ropv. There appears to be a
considerable rush ot home seekers to
avail themselves of the homestead
provision of this act and believing that
the government has taken some definite
steps thereby insuring that the proposi
tion of i-ritrating these lands will be
carried through to completion; it has
come to rnv notice that certain parties
are advoca'ing that the proposition of
the government is one of permanency
and are inducing homesteaders to locate
on these lands and are charging ex
orbitant fees for locating the ho e
eteader.
The official knowledge that I have is
to the eflect that these lands are only
temporarily withdrawn pending an in
vestigation by the government officials
as to the feasibility of the schemb and
so far, its investigation would appear to
iform the conclusion finally that the
original idea in view would have to be

water to irrigate these lands; from the
information at hand, it wouiu appear
that intending homesteaders should be
very careful before exercising their
homestead right, as it appears that these
lands are desert lands and parties woild
be unable to make a living theieon
pending the investigation and should it
be decided favorably, the completion if
these proposed works.
1 believe that the letter from the
Secretary should be given as much
publicity as possible and should be
carefully studied by each intending
homesteader. With this idea in view, I
would request that you publish the
letter of instructions, giving it such
official sanction from my office as you

SECRETARY HITCHCOCK'S INSTRt'CTIOXS.
You are hereby directed, in addition
to the instructions contained in office
circular of September 9, 1902, to call the
especial attention of all persons that
have made, or are intending to make,
homestead entries on lands that have
been, or may hereafter be, temporarily
withdrawn for irrigation purposes, to
the following statement:
The withdrawal of these lands is
principally for the purpose of making
eurveys and irrigation investigations in
order to determine the feasibility of the
plans of irrigation and reclamation
proposed. Only a portion of the lands
will be irrigated even if the project is
feasible. It will be impossible to decide
in advance of careful examination what
lands may be watered, if any. The
mere fact that surveys are in progress is
no indication whatever that the works
will be built, and this fact cannot de
termine how much water there may be
available, or what lands can be covered,
or whether the co6t will be too great to
justify the undertaking, until the sur
veys and the nr'gation investigation is
completed.
Attention is also called to the fact that
all entries made upon the lands referred
to are subject to the following provision
of the act of August 30,1890 (20 Stat.,
36D:
That in all patents for lands hereafter
taken up under any of the land latfs of
the United State? or on entries or claims
validated by this act west of the one
hundredth meridian, it shall be express
ed that there is reserved from the lands
in said patent described, a right of way
thereon for ditches or cana's constructfd
bv the authority of ilia United States.
Under this provision of the law,
should a homestead entry embrace land
that is needed in whole or in part for a
dam site, a reservoir, or a canal, the
land would be taken for such purpose,
and the entryman would have no claim
ogainst the United States f ir the taking
of ouch right of way.
You will post a copy of this circular
in a conspicuous place in your office
and give the subject matter hereof
such general publicity as my be pos

Coming to the rescue of his
mother, who was being beaten by
her drunken busbaud, Ray Jack
son, 19 years old, shot and
probably fatally wounded his
father, Alonzo Jackson, at their
home in Chicago, Wednesday.

They parsed a law in Iowa last year
permitting the confinement of confirmed
drunkards in lunatic asylums. It made
little stir, but within eight months 300
alcoholic patients were under restraint
and treatment. An Iowa dispntch says
that inebriates continue to flow into the
state asylums at the rate of about 50 a
month, and that an Iowa court has just
ruled that their constitutional rights are
not. violated bv their detention. Some
of tbe inebriates don't Uke to be sent up,
but the treatment they get seems to be
humane and salutary. Their liquor is
stepped, and they have to w rk on farms
and are encouraged to improve their
habits. When they 'seem to be cured
are discharged, and report sttys that so
far about 75 per cent of the cases have
