The cart is quite an invention and is almost indispensable in break ing horses. On the Kith, inst., Mr. Hand, who resides at Lostine, while at work on n barn in Alder, fell from the top of it, sustaining several bruises, and breaking his collar bone. Dr. Cobb was called, and under his care the patient is getting along nicely. This week a couple of High valley farmers got into a dispute over a rail fence, and kept railing away at each other till it became necessary to put in their arguments straight from the shoulder, which they did in a scien tific manner. One of the parties, we hear, is pretty badly used up. Contractor Johnson, with a force of men, left last '.Monday, to finish the Eagle Creek bridge. It, seems the bridge has been built so high in tho air that the only way to get on it is to have trestle work made about one hundred feet on each side, and Johnson and Wilson has been employed to, do the work for ?2fi0. Monday evening last, John Drake and Charley Chase wore arrested by the Marshal, for disorderly conduct, nnd locked up for the night in the city jail. Tho Swisher horse stealing' case was brought to a termination yoster dav in the Baker Countv circuit court, by thu motion for a new trial, being overruled and senteneo of two vears in tlie penitentiary being pronounced. The facts of tho caso are those: In Alay lSSt, Iloyman Swisher, of Haglc Valley, Oregon, took a mare belong ing to K, A. Whittakor, of tlie same place, and drove her along with a band of his own horses to thu state of Nebraska, whore she was sold. A friend of Air, Whittakor, noting under a feeling of dutv, and right in the mattor, informed Air. The mare was kept track of, and subsequently an agent was sent to Nebraska, who'pur elmsod her for 100, and brought her back on the cars to Baker City", Who appeared as a silent but emphatic witness. Some stirring speeches were made against the incorporation. Res olutions were adopted, denouncing the incorporation, and calling upon the County court to assert its right and protest tho claim of the county to that portion of its roads. It seems to be thought by porno that it is not a "legal coit,ty road," which may all bo so; but granting that it is not, it must be eotsylcrod that many private individ uals in this valley have considerable claim Upon that road. The county al so has a cUpn of oyer -f2,000 upon it. Can it ho that individual can seize upon and lak,c so, much property and appropriate to prhn'te uc? There cer tainly oan he no dilleifenee in takjug private property for public, tses and taking public property for private uses. If tlieie is any difi'erence in principle, the latter is tho more lieiniops. That road is public, prop erty and cannot be said to be anything else; besides the people can hold it by prcsciiption, as much of it has been used over ten years. Wo are certain there is as much law in favor of its he jug a vaJtd road as there oan be against it. Our people area unit on this ques tion ami are fully determined upon protecting their rights, at all hazards. It is well, however, that something has stirred us up to duty. That is a hard piece of toad to jfeep up, and expen sive. So long as the County Com missioners exerted themselves to keep up the road, the Wallowa would do nothing. Now, we have raised a sub scription of several hundred dollars, and tho money is being expended in a judicious manner. The Wallowa has done a great dea for the road, and the commissioners Juive done a great deal also. Wo rather think tjio Wallowa should do a little the most.
