Tills act must be taken as meaning that two co-upaniea may have j the right in common, to occupy for road purposes oue canyon. It does i not say that the road of oue company tjball be taken away from that company ana given to another, but tnati the new road must be made at the expense of this intruding company; and ahJo, that when the road of the old company is trespassed upon ny the new com pany, the new company must con struct Its own road at Its own expense, providing mat that ex pense is equitably divided f be tween the two. And, again, this law does not give the right to any one cor oration to take from another its property without compensation there ior. nut tne supreme court of; Ore gon, upon this very same law' does that very same thing. There Is but oue road through the canyon, and the court admits that Abraham audi Wil lis made that. The court theri says that if Abraham and Wiilis have not a prior and superior right to the' road they have at least an equal right to it with Fink and Gazley. But tbrn the court, in the face of Its own admis Mon, gives the exclusive right to the road to Fiuk and tiaxley, aud saddles the costs of the suit upon Abraham and Willis. There is certainly n reason in this beyond that embodied in tne expression " stand by! your friends," and leave as an only infer ence that the judges are either: poor reasoness- blind to the truth, or that they do not wish to see the truth. ' After this decision the peopleof Ore gnu should not want toelect the present judgts to the positions they now oc onpy; for the reason, that if by their aecistnns, they will rob w Ul and Abraham of their propeny - the time wight come when a similar declaim might be rendered agatust some one else. The gover nor pardons the criminal at the eud of one year, and turns the criminal loose upon the community at largei. The criminal has been but slightly pun ished, and has but little fear iof the law aud those who are chosen to exe cute its demands. He goes out upon the highway and commits a robbery, or burglarizes some domecile, and the end of the whole thing is the criminal la again sentenced, and if he plays it sharp, In a certain length of time he U pardoned a secoud time by. the governor, aud society Is roboed of the expense' compelled in securing the first conviction of tbe thief and rob ber, in that for the two crime com mitted the fellow possibly does not serve only the length of time pre scribed by the judtre iu nassinir the first sentence. It is uele-8 to speak of law or its j effects under such circumstances. If it has become known generally that there is to oe ouione punisnmentior two crim s therisk will be taken by the men who have no reputation to save, a nil who have been once convicted of felony.
