Hayes, the Arctic explorer, in an inter
view relative to the failure of the IIjII.
Expedition, expressed the opinion that
the "Polaris" was unlit for the ser
vice, and that injury to the vessel was
caused by defect in her build. "Capt
Hall," said the Doctor,"was 4G4 miles
from the North Pole, lit, ( Hall )
hot proven what I have predicted
long ago, that Smith's Sound was
navagable, and was a true passage into
he open polar sea, which he seems to
have reached. Why4 he was driven
back I cannot tell, probably by drifting
ice fields or gales of wiud , but I
have no doubt that he had reached
the Polar sea. There is one remarka
ble fact about his explorations. II:; had
constant sunshine all the time, and the
survivors who were drifting down

Hall seems to have broken through
the icebergs of Smith's Sound
which baffled both previous expeditions,
and succeeded in reaching the point
where both Kane and I claimed to
have seen the open Polar sea, in lati
tude 82 degrees 16 minutes, the most
northerly latitude ever reached by
any ship. His ship was 210 miles fur
ther north than Kaue's ship. I can't
understand why the survivers were left
fo the mercies of the floe, unless there
was difficulty on board tho the ship
ship. ' At the outset, at Drisco, there
was some difficulty betwee Hull and
Buddington. This wus settled by tae
Captain of the Congess. There was
something very mysterious in Capt
Hall's death. I wouldu't like to fay
that he was killed by one of his own
men in a mutiny, but it would almos
look so- I have never known of any
one dying in that region of apoplexy
and Capt. Hall certainly did uot look
like an apoplectic nun

be back here by September. The men
who deserted the flup probably did so
because of Halls death. He was a
brave and resolute man, and. stout with
determination to reach the North Pole
if it would take him five years to do it.
He was one of the pluckiest men I ever
saw, and would have staid two y:ars
more to accomplish his purpose if doath
had spared him death or murder, I
don't know which."
Prof. 13 aire, of the Smithsonian
Institute, thinks Hall's expedition far
from a failure, and has no doubt realized
many of the objects in view in sending
it out. '

in the following conclusions : That
children and idiots are not holdeu to
criminal responsibility that mental
unsoundness ci y excu.-e crime when

reason ; insanity excusing crime must
bo shown by experts to be a brain
disease; neither emotional nor per
ceptional insanity is an excuse itself
for crime ; all prisoners declared insane
should be put, in the 'Iuuatn aslums
until their restoration of health j the pun
ishment should be graded to suit the qua'
ity of tho crime and the intent and rela
tive guilt of the criminal. These opinions
are practical and generally sound, and
if adopted by our courts would tend
to rid us of emotional insanity alto
gether a result much to be desired by
those who do not expect to kill their
neighbors, and who may run some risk
of being killed by Iheir neighbors
while the latter, according to the
current doctrine, are legally irrespon
sible.
