Yesteiday afternoon A. M. Slier
wood met Jude John Kelshaw
upon tho street and inquired about
the charge that had been exam-im-d
lefore Kelshaw and a jury, in
which Shetwood was detendant,
the jiry having disagreed. Judge
Kclsiiaw told him he did not
know, that it all lay with the
prosecuticg witnesses, but that be
hoped the jury would be dis
missed. Sherwocd said he hoped
not, as he wanted to be tried and
.-H-quitted. He then commenced
to cab the judge names and said
that he had endeavored to rake up
cases against hi n. Kelshaw de
nied the charge, and one word
brought on another until Sher
wood struck Kelshaw with a
screw-driver, which he had in his
hand, and Kelshaw backed off and
endeavored to get away, but
Sherwood caught hold of him.
Kelshaw then drew a revolrer and
siioi Mierwooil three tini-.s, one
hall entered the liody near the
heart. The combatants struggled
for a few minutes before Sherwood
loosened his grasp and fell. Pop
ular opinion is that Kelshaw acted
m sell defense.

Miss Cora Arledge, a young girl
14 years of age. with her father,
arrived in town last night from the
forests of the West and from the
Big Horn basin. Miss Arledge
met with a most serious and re-
ma' kable accident at her home
recently. Her fa' her is a ramb
tnaninthe Big Horn basin, and
one day last week a jcowboy rode
tip to h 8 ranch on a young horse
that he was breaking. In a spiri'
of jeet he dared Miss Cora to rid-t
the horse, when, without a
thought, she vaulted into the
saddle, throwing her leg around
the horn, and the hoiee in to buck
ing and pitching at a furicus rate,
but she stuck to him, quieting him
every jump. Then the horse be
pan to run and ran for two straight
hours over the prairie, with Mi.-s
Arledge hanging to I he reins and
three cowboys in hot pursuit.
One of (hem at last succeeded in
lassoing the frightened animal ar.d
gradually brought it to aMandstill.
Miss At ledge was told to get off,
but she answered that she could
not, and just then the horse made
another plunge, broke the lasso
and started again on its wild
career. It ran for over twenty
miles and then dropped dead, a-ul
its daring rider was found. un
conscious by its side. At fir.-t it
was thought that her h g was
broken, as she did not appear to
have the uee of it, but upon an
investigation it was found that no
bones were btoken, but the
muscles of the light leg. from the
long severe strain in holding on to
the horn cf the saddle, had lest
their power, and her leg hangs
limp and useless She was sent to

Important Timber Cane.
A motion was agr-ed to in the
CniUd States supreme court
Tuesday, in which thousands of
men, who heve taken up the
heavily timbered land of Oregon,
Washington and California, under
the act of Juue 7, 187S, as timber
land, are interested. The I'nited
States courts on the Pacific coast
have un formly decided that lands
"chiefly valuable for timber, but
unlit for cultivation," were limber
lards within the meaning of the
act, but the interior department
lias held that if they were valu
able for timber, but capable of be
ing ma le agricultural land at any
coat, then they were agricultural
lands. The result is that under
such a construction, it is contended
there is little or no t inber land,
unless it was to le found, the
department of the inteiior
decbred, "in the rugge.l, barren
and mountainous regions." In
the case of the I'nittd Stites vs.
Budd & Montg m-ry. there was a
suit brought to cancel a patent on
that ground. I'nited Slates District
Judge II an ford decided that it was
timber land or else there was no
ti nbt-r land in Washington. Now
the I'nited States, through the at
torney general, appeals the case
and asks that it be advanced. The
supreme court decided to advance
the case, inasmuch as there are
thousands of cases depending on
this decision There will be a
hearing January 11 next.

Marguerite of Austria, abbess of
the community of noble ladies, is
improving, and may, it is thought,
regain her health. The prince-s
is the most beautiful woman con
nected with the Austrian imperial
family-, and also ths most religious.
As head of the community in
Prague, the aobess has earned a
reputation for sanctity that may
help to place her in the lifct of
saints. There appears to be no
romance connected with her adop
tion of the veil. She is now 21
years old.

night train irotn Chicago on the
Milwaukee & St. Paul load was
rob'-ed by masked men near
Western l'n:ou junction at one
o'clock this morning. The train
had been out to a junction twenty
three miles south of this place, and
w en within about a hail a mile,
the fireman, Edward Averill, who
was putting fomc coal into the
furnace, was st n tied by a imife
behind him. He turned around
