Witness examined the buddings the next morning. He also went to the house of the deceased. He saw a pheasant that had been recently killed lying upon the table. There were no loaded cartridges in the house, and none were f und on the body the evening before. At llerry's house the table was set for one, and the digues were not washed. On the night of the kill ing the defendant Bttid that some people had been coming around ihe house. That nig'it he told the Oakley boy to stay in the house and the hired mail to take the 41111 and so to the barn and watch. He took the pistols and went to the orchard, lie said he had been up late at night lately and was sUepy. lie took a stand behind an apple tree and went to sleeo. Dr. W. II. Davis testified that he had examined the wounds of the deceased about 11 o'clock on 'lie night of toe shooting. He corroborated the former wuuess as to pinion of body and gun.
