Bittner la Jus lot Hamph-ej's Court The case of the six defendants arrested for committing riot at Sweet Home, by breaking down the door of the Evangelical church, came up in Justice Humphrey's couit at 1 o'clock yesterday. Deputy District Attorney J. R. Wyatt apppered for the state and J. J. Whitney for the defendant. Rev. II. I. BiUner demanded a separate trial, which was granted, and the case was commenced. The witnesses on the part of the state all agreed in their testimony which was in suh.nance that Kev Mr. Bittner and his followers came to the church to hold services and found the door barricaded by the anti-Bowman men .ho were inswle, Mr. Bittner told his followers that they had a right to go into the church, even if they had to burst down the door: that the uelemlants procured a stout pole and convert- nit! it into a batten ng-rani broke down the doors and entered the church. This the defendant admitted ex cept that he testified that he did not advise his congregation to use any violence, lie testified that the men inside hud clubs and a stone was thrown at him as he en tered the pulpit. This the wit nesses for the state denied, stating that the clubs, one of which was a small hazel stick, was introduced in court, were used in fixing the bell. The stones, which were also introduced in court, were small. Hat stones, such us the lioys threw at the birds, and the witnesses for the state denied having seen or us id them. The case introduced the tiresome question 'of the rupture in the church, each taction charging mat they were the church and that the othir had withdrawn by virtue of that rupture. Some of the witnesses testified that, there were tt. reals of shooting anil blood shed, and that Rev. .Mr. McElrny received a blow upon the wrist wi'h a club. The case was continued in the evening, when some more clubs, which were formidable looking weapons, were introduced in evi dence. They were found inside the church. The evidence was all in at it o'clock, and the court ad- ionrned until S o'clock this morn ' :.. ......... :n i 1 nig, w'-en tjie case will be argued. 1CKAI. ESIATK SALES. J L Cowan to Geo. THE HOSPITAL BUILDING. Tbe Lgisla'.nre Cannot We'd Befose the Appropration Ak. d For A committee from the Ladies Aid Society of Albany, consisting of Mrs. M. J. Train, Mrs. Cora Honkins. Mrs. L. E. Blain, Mrs. C. W. Sears, in conjunction with a committee of two. Mayor J. L. Cowan, and Judge L. Flinn, on the pait of the citizens, have been be fore the committee on ways and means oi the Oregon legislature for the purpoe of presenting the matter of an appropriation from the state of $ 10,000 for the Albany orphan's home and hospital which should certainly be granted. The following s'atement present ed tothecommitteePhows wiiat the society has been doing and what it asks of the legislature : The Ladies Aut Nieiefy, oi Albany, Oregon, in pretenting a petition to the Oregon Legislature tor an appropriation of if 10,000.00, begs leave to submit the following reasons for asking for buch appro priation : Fifteen years ago, this society was organized for the purpose of extending aid to the sick and needy, anil during the years since its organizition, it has labored at. a great disadvantage, owing to the absence of a sutiable building in which to care for those in need on a systnuatic and economical plan. In spite of this fact, the society has dispensed means and support to forsaken and neglected children, the destitute, sick and unfortunate, to the amount of $7, 500.00. This amount would have reached much farther, had the society possessed a home or hos pital building, in which to provide for them on a systematic "basis. Realizing this fact, in January, 1K), the society called a public meeting of citizens, in Albany, Oregon, lor the purpose ot securing money, winch should tie a nucleus tor tlie establishment of an Or phans Home and Hospital. From aid generously tendered by citizens, a block ofgiound, valued at $4,00 ', m the s iburbs oi Albany, was secured, and money donated which enabled the society to undertake the erection of a suitable building for an Orphans Home and Hospit al, upon which $.',000.00, has been expended and which will cost when finished, $15,000.00. To assist in completing this home, the Oregon legislature, which has so generously aided similar, charitable institutions, in various portions of the ttate, is asked for an appropriation of $10, 000.00, which, with the funds al ready available by the society, will enable it to carry forward the work now under way. The steadily increasing nnmber of appeals for relief has rendeied the erection of such a building a necessity, as at present the society is paying to have those depen dent upon it kept in similar in stitutions, in other parts of the state. The budding is already erected and enclosed, and there is now urgent need for an appropria tion of not less than $10,000.00, with which the society would he enabled to have the Home ready for occupancy by the spring of the present year. In view of the foregoing facts, your committee is most urgent iy rtipistcd to include tills amount for the Orphans Home and Hospit al, of Albany, Oregon, in the general appropriation bill. The ius'ituiion is one deserving aid from the stat?, and although the piesent legishiUne is taid to favor retrenchment and economy in all legislation it is hoped this aprorriation of $10,000 will he secured. Albany is the only city in Oregon of its size having no public institution receiving aid from the stale, and in view of the appropriations heretofore made to similar institutions in different portions of Oregon the members cannot consistently refuse ths ap peal f.r aid for this de.-erving charitable enterprise. I'uttlng up Falsework. The Eugene Register says : The false-work for the railroad bridge across the McKenzie on the Co burg road is being erected and I'oubtless in a short time the bridge will assume si ape. Piles have been diiven at the north approach and a temporary track for carrying limbers has been laid there. About fifteen men are now at work on the bridge and Mr. Scott, foreman of the work, says he ex pects about six or eight more on this week and w ill keep at Itat twenty men at work hereafter. The general superintendent of the bridge says it will be pushed right along and the road will be complet ed to Springfield as soon as possible Work on the bridge has been delay ed some on account of being unable to secure some extra large timbers as early as wanted, they had to be obtained at Mill City, on the east ern extension of Oregon Pacific. !
