It is worthy of note that at the present term ot the circuit court not a criminal case appeared on the docket. The injunction sued out on a complaint emanating from Wallen- roft i; Moi'kvvell. of the Alcazar Thealre.to restrain Jani s A Herne f ..I ; till , ironi piayng "I learls of Oak" nt the Bush Street Theatre, Jhas bc-ii dismissed by .-superior Judge L Lawler. The case aupnais lo lie that Wal lenrod t Stock well claim that Heme was booked for the Alcaxir Theatre under a c infract made with Randall & Dickson in Mav lat, who were to play Mr Heme for the season. Failing in their contract, Mr Heme entered into an engagement with his present managers, Messrs Haw ley & Mit chell, who naturally reused to recogni.o the Walleurnd & Stock well claim. Wallen rod claims that he has a letler wherein Ieavitt.the proprietor of the Bush Street Thea tre, admits the existence of t'ie Alcazar contract. It seems that the attorney for the Alcazar Theatre off-red to set tle the claim for $3 ;0, but Mr Heme's manager refused the mon ey because he did not see where tfie indebtedness came in upon the so-called Ale i.ar contract. The Daily Report says.- "A curious episode of the case is that yesterday at 11 o'clock Mr Wallen rod of the Alcazar Theatre assured MrGottlob of the Bnsn tha' he would put on 110 injunction and do nothing to injure the Bush-street Theatre, but would simply brinu su:t auainst Heme. II said furth er that should any proceedings have to be brought that would in volve the theatre the papers would lie served in the morning, so that bonds could be furnished. Never theless Mr W til 1-Mi rod's dummy. Mr Cross, served the injunction last night just before the hour for the beginning of the performance." Rather than pay the demanded .-ftiOO, the interested parties looked upon the proceedings as extortion ary, dismissed the aud'ei ce, and closed th" theatre. When the case was ca'lcd before Judge Lawler this morui::g ho di-mis-ed the injunction without pleading, ile -lariiu: its issue illegal ; and strange to i-ay, there was ir one present to advocate tiie sus taining of tin! injunction. The case was a licistcr-rliaordinarvone. The I'o-t states that. "Suits for damages will be commen -cd against Walleiirod by ti.e part-es who were made I rfendant to the suit. At Price .t Kohson's can be seen a machine that will ir.terest every fanner in the Willamette valley, it is a very simple bdle nue hine for the sep iratin' of wild oats from other grain. The entire secret seems to be in the apron over which all the grain passes. It is made of canton flannel and the wild oat, in passing over it, catches by the beard where it remains un til taken a.vay by a brusher, which automatically t asscs over it. If the rniicl.ii, e does its work as claimed, and it S'-ems to do it, the inventor is sure of a f irtune. The machine is represented here by Win. Wright. A Surgical Operation. Yesterday Dr. Hill performed a surgical operation upon Win. Lewis of Philomath. For many weeks Mr. Le a is has been suffer ing from an inability to breath easily through the nose. The mal ady increased until breathing was entirely obstructed. He then came to this city and consulted a physic ian who pronounced the cause to be a polyphus- in the noe and suc cessfully jierformed the operation of removing ir. MraiiIel. The Fast India Catar.h Remedy Company, which left this city some time since with a company of singers, recently stranded at Yreka, . Cal. A Novel Idea, Labt Friday an old man named Peck was taken from Lane county to Slem, to serve his third term in the ienit ntiary. His case is quite an argument in favor of the unlimited sentence idea recently introduced in an eastern state. By its provisions a prisoner is always sentenced to an unlimited term. He is released on good be havior, that is given, his freedom on good behavior as it were. He must rep-.rt every month to some oflicer whose duty it is to keep a record of all men on probation. By this mean 8 an honest roan cai redeem himself, but a scoundel is soon taken in charge again thus saving to the state many dollars for arrest incarceration, prosecu tion etc. . Stricken With ParalyaU, For some time Mrs. B. A. Ilaight has been visiting with her son J. K. Ilaight near Peoria. Last week as she desired to return to Alband, they started down in a buggy and when within a few miles of town she became sudden ly sick, and a few momenta later was stricken with paralysis, the stroke affecting only her left side. Mr. Haight supported her in his arms until they arrived at the residence of Grant Haight in this ciry, wnere sne was removed aid medical are summoned. She is still in a very precarious condition but will survive the shock should she receive no relapse. A Noted Divine, Rev.
