Patrons of the paper the change. will phwo observe THAT KA1LROAD DECISION Comment and discussion h-.-t been freely indulged in by the prefs of the country, upon the late decision of the United States supreme court, upon the Minne sota railroad coinmisdion case. The Railroad Commission of that etate fixed freight rates and fare?, under an act of the legis lature empowering them so to do. The railroad demurred thereat and took the matter into the courts. The pupreme court of the Htate decided that the comniisfion had the power, and the cae was taken up to the United States supreme court, where the decision reversed the action of the Minne HOta supreme court. The New York Tribune, ' which takes the extreme railroad Hide of the question says : "The question atisaue in these cases might al moet ba stated thus: "Dj the railroads in this country belong to the states, or to their owners ; are they required to transport for the public benefit exclusively, or in part for the benefit of the people who have invested money in them?" While the action of the Minnesota Railroad Commission, which the Supreme court was called upon to review, did not ab solutely confiscate property or render it entirely valueless, yet the principles underlying that action, if logically carried out by a Legislature or by a State commis ion acting under legislative authority, would practicallv leave the railroads without any power to earn dividends for their owners, fxcepting when farmers and other hippers are satisfied with their condition and with remuneration : their labor and services It is not essential in connection with this point to consider in de tail the precise orders reviewed by the Supreme Court. The ques tion is not so much whether those orders were just or unjust, as whether n couimis-ion created by legislative authority had final power to decide whether rates made were just or unjust. The principles involved in the legisla tion by Minnesota, and by other Granger States s well, were at issue before the court, rather than the precise applcation of those principles. On behalf of the sup porters of State regulation of rail roads, it was claimed that the btato had final power to decide whether the rates made by different companies were reasonable or just, and that the decision of a com mission charged with authority by the Legislature could not " be reviewed or questioned in the rourts.'" The decision of the .Supreme Court, on the contrary, is in effect simply this, that the legislature has no right to take the property of a company without duo process ot law, and that if a legislature, or a commission created by a legisla ture has final authority to decide whether rates are or are not reasonable, and if the company atlcctecl lias no oportuntty to appeal to the courts Ijt redress, the legislature may take the property oi the company without due process of law." This view of the question, as by the Tribune, is so emphatically and entirely upon one side of the jug, that it is in reality a fraud and a delusion. It entirely ignores thc"interests involved, expecting those belong ing to the railroad side of the question, and takes a miscon ception as to the basis of its argument. Railroads condemn and appropriate private property to their uses, and become public carries, and yet the argument of the Tribune and the decision of the Supreme court under the interpretation of the Tribune means that there is no meanB of putting any restriction upon the charges that railroads may make. But the facts of the case are that the decision does not rest upon the point of whether there is power vested in etate legislatures to control and keep with bounds the railroad charges, but upon the joint of whether in this indi vidual case the rates fixed by the commission were reasonable and juet. The decision merely holds that the reasonableness and justness of rates fixed by a commission are Bubiect to review bv the courts, i and are not final as nromulsrated I by the commissions. ' The Tribune goes on to sav mat : "there is force in the statement by the minority of the court that the decision thus rendered overrules, at least in a measure, previous decisions by the same court re garding the regulative power of the legislature. But it has been gravely doubted for years past whether the tendency "of judicial decisions has not been too far on the side of absolute control of the property of corporations by state legislatures, Investors have felt, not without reason, that these de cisions have gone far toward de priving them of virtual owner ship or practical use of their property, and toward conferring upon legislatures, and through them upon the public, the virtual ownership and practical two of such property. The new decision by the court indicates a decided movement in the opposite direc tion, and is likely to be of great influence in checking unreasonable i action by state Ugislut'ireH and state commissions. " The position taken in this that the previous decisions were "too far on the side oi absolute control of the property oi corporations In state legislatures," is certainly a gross misrepresentation, for legis lative ami commission action lias never yet touched the property of corporations; but has only at tempted to control the power of the railroads to levy upon the property of others. The position taken by theTribune would simply give the railroad full sway in that direction.
