Patrons of the paper will plcaec observe the change. METHODS OF LA W SUITS. Tub ways and means of con ducting suits at law, in order to gain them, or in attempting to gain them are various, and will not all bear the crucial test of justice, at least that would seem to an unbiased man to be the case. Take for instance the recent mining euit that has been on trial in justice courts and before the circuit court in this city, in which M. V. Eilyeu, Amos Strong and othere were suing to recover possession of their Red Bull mining claim, situated at Quartzville in this county, which a correspond ent recently alluded to in our columns. The history of the case as we understand it ii that in June 1887 the plaintiffs located a mining claim near the White Bull, located at Quartzville, and in October 18S8 when the plaintiffs were about to prove their claim, the defendant E. O. Smith jauiped the claim and did some work upon it. About the 20th day of December, as ap peared on the trial, the plaintiffs went back with some hired men to put in a large amount of work on their claim during the winter of 18S8 and 18SS, in constructing a tunnel and otherwise developing their mine. In about fjur or live days afterward-, as the testimony showedon the trial, the defendant swore out complaints against the plaintiffs and their hired men in an obscure justice court charging them with stealing quartz from the mine, and had them driven off of the claim. The plaintiffs', alter receiving council, at to their rights, again returned to work upon the claim about the 23th of December 1888, and again commenced work upon it, when the defendant again came and had them and all their hired men arrested upon the charge of stealing quartz from the mine. The trial of this case first com menced before justice Humphrey in the winter oi 1887, and judge ment was rendered in favor of the plaintiff for the possession of the claim. The defendant then ap pealed to the circuit court of Linn county, and after a two days trial before a jury again the plaintiffs were given the possession of this claim. The eaeo was tried before a jury of twelve of tho most sub stantial citizens of Linn county, who, after the cause was submitted to them, returned a verdict in favor of the plaintiffs, after being out a few minutes. On the first ballot tho jury were all for the plaintiffs. There was great interest manifested in the case from the beginning, and the court room was packed with people to here the verdict of the jury. Now the peculiarities- of the methods employed, to endeavor to win the case in the trial and to work for a final winning, crop out. For all through defendant has based his hopes of winning upon the fact, as he has stated, on being backed up bv rich Portland capi talists and that the power of this mnnev that was backing i would finally win the case. The statement made by the defendant E. O. Smith, that he, by being backed up by the Port land banks and D. P. Thompson and Sim Reed, would be ablo to bold the claim no matter how just was the case of the plaintiffs, cer tainly indicated a most nefarious design on hia part. In all proba bilitv bis statements are not true, for as honorable gentlemen aa Mr. Thompeon and Mr. Reed have al ways been counted, would not lend their influence to any such in. rnn. scheme. Undoubtedly in out of their just claims by the freeze out echemea of wealthy op ponents, but sueh barefaced pro ceedings an are indicated by the defendant and his backers in this instance cannot prevail, and for the benefit of the fair fame of D. P. Thompson, who has held the highest esteem and confidence of the people of this part of the state, we hope that his connection with it will be proven to have been wholly in the mind of one E. O. Smith, whose bold attempt at the bluff game has so signally failed.
