change. The train leaving Port

Howe and seven others began suit
in the state circuit court to-day
against S. W. Blasdel, the Nestor
Mining Company and others, for
$10,000 p.nd an accounting. The
suit grew out of mining property in
Baker county, valued at about
three thousand dollars, for which
Bl.asdell acted as agent.
BOY KILLED AT SALEM.

the 4-year-old son of K. J. McKil
lop, living between Lincoln and
Wheatland, below Salem, yester
day evening accidentally killed
himself while playing with a self
cocking revolver. Four little chil
dren were in the house playing,
when .the boy found the loaded
weapon in the cupboard, and
while handling it discharged the
loadinto his breast. Death re
sulted instantly.

tion, was placed on its final pass
age in the senate and failed.
The honse passed the military
bill with a provision levying one
flfth'of a mill tar for the support
ef the militia.

of the legislature both houses are
holding night sessions.

A Restaurant Burned Lose Abosrt

story frame building on Main
street occupied by Wm. Snider as
a restaurant and lodging house,
was almost entirely destroyed by
fire this morning. The loss is
$1500 which was insured. The fire
is supposed to be of incendiary
origin.

the apprehensions of a serious Hood
have lieen diseipated. Rejiorts
from nil points up the river are to
the fifed that it is stationary or
falling, and the same is true of its
northern tributaries as well as the
Kentucky river.
If there is no heavy rain in the
Ohio valley w ithin 48 hours the
river will not rise lieyond sl feet
along the water front.
In this city basements uro flooded
and the first Moors of some stores.
Merchants generally h.ive hauled
their good to places of safety.
Factories on Water and Front
streets have supendedftf mporarily
and navigation is etopjied by the
high water and the swift current.
Several coal barges were sunk by
a collision with the bridge.
Advice from various points
along the Mississippi to-night
shows that there has been no ser
ious increase in any of the levee
breaks, but at the same time not
much head way is being made to
ward closing them. The water
continues to pour through the
Orfuits and Raleigh bl'eaks into
Mississippi and Northern Lonisana
and all the land in that vicinity is
badly flooded.
At Arkansas City the river is
rising again to-night und the
water is (touring down ou the
town rrtpedly.

introduced a bill 'for the purchase
oi hind iu Ireland and for the im
provement of the poorer and more
congested districts. The bill also
provides for the establishment of
an Irish land department. It is
designed to use one-fourth per
cent from the tenants annual four
per cent as h. fund for the erection
of laliorers dwellings. A grant of a
million and a half from the Irish
church surplus is to be devoted to
relciving the congestion and foster-
t i ing the industries and amcliorat
mgSh econduion in the poor dis
trict". The hill passed to its first

report of the majoi ity of the sen
ate committee on elections upon
the Montana election case was
submitted to-day by Hoar. The
majority report gives at tbe outset
the circumstances surrounding
Saunders nd Powers by the re
publican legislature, aod Maginnis
and Clark by the court house
legislation. This double choice
was caused by tho fact that the
state M-nate was equally divided,
and both sides claimed the major

The report says the caso turned

Silver Bow county. Tbe majority
thinks the election held at precluct
34 was illegal and fraudulent. The
majority in conclusion decline to
entertain the proposition that be
cause the governor failed to recog
nize the republican legislature it
was hot legally constituted, and
hold that position as untenable,
they also declare that there is no
authoiity in congress to lemand
the matter back to the peopled
Montana. The conclusion reached
is that Saunders aud Powers are
entities to seats.
The minority report asserts that
