While in the ford the horse became disengaged from the buggy by the breaking of a bolt. The horse plunged and j finally got away, leaving Mr. Woods and the ouggy in the roar ing fc'antiam canal. The horse stopped at the barn, and the bug gy was easily extricated, without much damage. . , Value of Timber Taken. The Astorian recently made the fo'.lowing truthful observation: A letter is received at this office signed, "Surveying Party, Lewis and Clarke's river," asking who intends to settle damages to timber cut down by the Astoria & South Coast railroad company, in passing througn with the line of road, or if anybody has been appointed to ad just these claims. Tie man who wrote that letter was apparently ashamed to sign his name to it. It might be asked what value would attach to that timber if the road didn't run through it; or, would the owner be willing to pay the company the additional value ac cruing to his timber by reason of the road passing through it. If a credit and debit account were es tablished, it would probably be found that for every dollar's worth of timber cut, the timber left standing would be increased ir value a hundred dollar's worth. The case was argued at length, ;:nd a beautiful tribute was paid by the counsel for the vtate to brave Jack .Miller, who lost his life at his post ot duty. The case was given :o the jury about 5 o'clock and after being out half an hour they returned a verdict of not guilty. The case against l'Yed Kobe was also dismissed, and both of ihe prisoners were discharged. Considerable feeling was ex piessed over the tennination of the case, especially as young llolte and Hill had each made a confession to the effect that the two were guilly of displacing the switch, which caused the wreck, and there are few people who do not believe them equally guilty. The slat.is of the case is this : The con.'ession of Hill was made without so'k-itation and was ad mitted in eyideuce. This, together : with the circumstantial evidence was sufficient to convict him oi manslaughier The confess'on of young Kolie was obtained upon urgent solicitation to the effect that it would lie better for him to tell the ti nt Ii.
